BILL NUMBER: S6915 SPONSOR: FLANAGAN TITLE OF BILL: An act to authorize the town of Smithtown to extend the boundaries of the St. James fire district to include the village of Head of the Harbor PURPOSE OR GENERAL IDEA OF BILL: The bill would allow the town of Smithtown to expand the St. James Fire District boundaries to include the village of Head of the Harbor. SUMMARY OF PROVISIONS: Section 1-Authorizes the town of Smithtown to expand the boundaries of the St. James Fire District to cover and include the village of Head of the Harbor. Section 2-The expanded fire district shall be subject to the provisions of article 11 of the town law.

FLANAGAN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to authorize the town of Smithtown to extend the boundaries of the St. James fire district to include the village of Head of the Harbor THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of article 11 of the town law to the contrary, upon the expiration of the contract between the village of Head of the Harbor, in the county of Suffolk, and the St. James fire district, providing for fire protection and emergency response by such fire district within such village, the town board of the town of Smith- town is authorized, in accordance with the provisions of subdivision 2 of section 170 of the town law, to extend the boundaries of the St. James fire district to include the village of Head of the Harbor in its entirety for the purposes of providing fire protection and emergency response within such village. § 2. Upon the extension by the town board of the town of Smithtown of the St. James fire district to include the village of Head of the Harbor, in accordance with section one of this act, such fire district and town board shall be subject to the provisions of article 11 of the town law, and shall continue to have all powers, duties and responsibil- ities vested in and imposed upon such districts and towns pursuant to such article, and the rules and regulations adopted pursuant thereto. § 3.
