TITLE OF BILL:

An act to amend the public authorities law, in relation to directing the
New York state energy research and development authority to study and
make recommendations regarding siting renewable energy resources at
decommissioned or dormant electric generating sites; and directs the New
York state energy research and development authority to issue a request
for proposal in support of a renewable energy project at a dormant elec-
tric generating site

 
PURPOSE:

To encourage the reuse of decommissioned or dormant electric generating
sites for renewable energy purposes; this will help the fight against
climate change and help the economies and tax bases of impacted communi-
ties.

 
SUMMARY OF PROVISIONS:

Section 1: Adds a new section 1884 to the public authorities law that
directs the New York State Energy Research and Development Authority
(NYSERDA) to prepare a report, in consultation with the Public Service
Commission and Empire State Development Corporation, containing recom-
mendations for siting renewable energy resources and energy storage at
decommissioned or dormant electric generating sites. The report must
include a survey of decommissioned or dormant electric generating sites
around the state, an identification of renewable energy development
opportunities at these sites, an assessment of the impact of repowering
dormant electric generating sites with renewable energy on local employ-
ment and local tax bases, and recommendations for further development of
renewable energy resources and energy storage projects at decommissioned
or dormant electric generating sites.

Section 2: NYSERDA is directed to establish the "repowering with renewa-
ble energy" program to develop renewable energy resources and energy
storage at decommissioned and dormant electric generating facilities.
After the completion of the report required in section 1, NYSERDA is
directed to issue a request for proposals through the New York Green
Bank for a repowering with renewable energy project at the Lovett Power
Plant in Rockland County. After the selection of a successful bid for
the repowering with renewable energy project at Lovett, the authority
shall, as appropriate, open solicitations for additional repowering with
renewable energy projects around the state.

Section 3: Effective date

 
JUSTIFICATION:

New York is working to become a leader in the fight against climate
change. Around the state, many older fossil fuel power plants have
either been decommissioned or are used only as "peaker" plants, active
for a few days a year. The loss of these power plants has often had
severe impacts on the health of the local economy and strength of the
tax base in impacted communities. However, these sites may provide the
ideal location for development of renewable energy sources as they are
already fully connected into the power distribution network.
This bill directs NYSERDA to produce a report analyzing the feasibility
of siting renewable energy sources at decommissioned or dormant electric
generating sites and to issue a request for proposals for a pilot
project at the Lovett Power Plant in Rockland County. The repurposing of
this site for renewable energy would bring tremendous benefit to the
taxpayers and economy of northern Rockland, and would provide an example
for reusing other generating sites for renewable energy.

AN ACT to amend the public authorities law, in relation to directing the
  New  York state energy research and development authority to study and
  make recommendations regarding siting renewable  energy  resources  at
  decommissioned  or  dormant electric generating sites; and directs the
  New York state energy research and development authority  to  issue  a
  request  for  proposal  in  support of a renewable energy project at a
  dormant electric generating site

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public  authorities  law  is amended by adding a new
section 1884 to read as follows:
  § 1884. REPORT; ENERGY STORAGE AT DECOMMISSIONED OR  DORMANT  ELECTRIC
GENERATING SITES. 1. FOR THE PURPOSES OF THIS SECTION:
  (A)  "RENEWABLE  ENERGY  RESOURCES" SHALL MEAN RESOURCES THAT GENERATE
ELECTRICITY OR THERMAL ENERGY THROUGH THE USE OF THE FOLLOWING TECHNOLO-
GIES: SOLAR THERMAL, PHOTOVOLTAICS, ON LAND AND  OFFSHORE  WIND,  HYDRO-
ELECTRIC,  GEOTHERMAL  ELECTRIC,  GEOTHERMAL  GROUND  SOURCE HEAT, TIDAL
ENERGY, WAVE ENERGY, OCEAN THERMAL, AND FUEL CELLS.
  (B) "ENERGY STORAGE" SHALL MEAN SYSTEMS THAT STORE  ELECTRICITY,  THAT
WAS  GENERATED BY RENEWABLE ENERGY RESOURCES, THROUGH MECHANICAL, CHEMI-
CAL, OR THERMAL PROCESSES FOR USE AT A LATER TIME.
  2. (A) THE AUTHORITY IS  HEREBY  DIRECTED  TO  PREPARE  A  REPORT,  IN
CONSULTATION  WITH THE PUBLIC SERVICE COMMISSION AND EMPIRE STATE DEVEL-
OPMENT CORPORATION, CONTAINING RECOMMENDATIONS REGARDING SITING  RENEWA-
BLE  ENERGY  RESOURCES  AND  ENERGY STORAGE AT DECOMMISSIONED OR DORMANT
ELECTRIC GENERATING SITES.
  (B) THE REPORT SHALL INCLUDE, BUT NOT BE LIMITED TO:
  (I) A SURVEY OF DECOMMISSIONED OR DORMANT ELECTRIC GENERATING SITES IN
THE STATE;
  (II) AN IDENTIFICATION OF RENEWABLE ENERGY  DEVELOPMENT  OPPORTUNITIES
AT DECOMMISSIONED OR DORMANT ELECTRIC GENERATING SITES;

  (III) AN ASSESSMENT OF THE ECONOMIC IMPACTS ON AFFECTED COMMUNITIES OF
REPOWERING  DORMANT  ELECTRIC  GENERATING  SITES  WITH RENEWABLE ENERGY,
INCLUDING IMPACTS TO THE LOCAL TAX BASE AND LOCAL EMPLOYMENT;
  (IV) AN ASSESSMENT OF THE IMPACTS ON ELECTRIC SYSTEM RELIABILITY;
  (V)  AN  ASSESSMENT  OF  THE  SITING  PROCESS IN CONVERTING BROWNFIELD
LOCATIONS TO RENEWABLE ENERGY  RESOURCE  AND  ENERGY  STORAGE  PROJECTS,
INCLUDING A REVIEW OF THE APPLICABLE STATE AND LOCAL LAWS; AND
  (VI) RECOMMENDATIONS TO FURTHER DEVELOP RENEWABLE ENERGY RESOURCES AND
ENERGY STORAGE PROJECTS AT DECOMMISSIONED OR DORMANT ELECTRIC GENERATING
SITES.
  3. THE AUTHORITY SHALL SUBMIT THE REPORT REQUIRED PURSUANT TO SUBDIVI-
SION TWO OF THIS SECTION TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE
SENATE  AND THE SPEAKER OF THE ASSEMBLY WITHIN ONE YEAR OF THE EFFECTIVE
DATE OF THIS SECTION.
  § 2. The New York state energy research and development  authority  is
directed  to establish the "repowering with renewable energy" program to
develop renewable energy resources and energy storage at  decommissioned
and dormant electric generating facilities.
  1. After the completion of the report established pursuant to subdivi-
sion  two  of  section 1884 of the public authorities law, the authority
shall issue a request for proposal through the New York green bank for a
repowering with renewable energy project at the Lovett  Power  Plant  in
Rockland  county  (Lovett).  Such  solicitation  shall leverage existing
state programs to attract competitive private investment in the program.
  2. After the selection of a successful bid  for  the  repowering  with
renewable energy project at Lovett, the authority shall, as appropriate,
open solicitations for additional repowering projects in the state.
  § 3. This act shall take effect immediately.
