BILL NUMBER: S1201 SPONSOR: HARCKHAM TITLE OF BILL: An act to amend the public health law, in relation to competency exams offered to qualified home care services workers residing outside this state PURPOSE: The purpose of this legislation is to amend the public health law by requiring the department to maintain a schedule of when they will offer competency exams to qualified home care service workers residing outside this state in order to fill any shortage of home care services working in this state. SUMMARY OF PROVISIONS: Section 1 amends Section 3613 of the public health law by adding subdi- vision 7-a which would require the department to maintain a schedule of

HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to competency exams offered to qualified home care services workers residing outside this state THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3613 of the public health law is amended by adding a new subdivision 7-a to read as follows: 7-A. THE DEPARTMENT SHALL MAINTAIN A SCHEDULE SETTING FORTH WHEN THE DEPARTMENT SHALL OFFER COMPETENCY EXAMS TO QUALIFIED HOME CARE SERVICES WORKERS RESIDING OUTSIDE THIS STATE IN ORDER TO FILL ANY SHORTAGE OF HOME CARE SERVICES WORKERS WORKING IN THIS STATE. SUCH SCHEDULE SHALL BE MADE AVAILABLE ON THE DEPARTMENT'S WEBSITE AND READILY ACCESSIBLE BY THE PUBLIC. § 2. This act shall take effect on the sixtieth day after it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such date.
