TITLE OF BILL:

An act to amend the administrative code of the city of New York, in
relation to requiring a process for notification of new homeless shel-
ters and conducting a public information session in the community where
the proposed shelter is to be located

 
PURPOSE:

This chapter amendment makes changes to the administrative code of the
city of New York.

 
SUMMARY OF PROVISIONS:

The amendment requires that there be a public information session,
instead of a public hearing, that allows for public comment and that
gives the public an opportunity to raise questions and concerns to the
agency about the homeless shelter and its location. DHS would also be
required to post the notice of the information session on the agency's

website. The Chapter Amendment would also require that notification be
provided to federal, state, and local elected officials annually during
the first quarter of each calendar year; elected officials would be able
to provide their suggestions for potential locations for homeless shel-
ters.

 
JUSTIFICATION:

The Governor approves the intent of this legislation.  Pursuant to
approval memo 72 of 2020, the Executive was concerned that a public
hearing requirement could cause delays and impose administrative burdens
that could hamper the shelter siting process.  The Executive believes
that this chapter amendment achieves a balance between the need for
notification and public input with the operational realities of adminis-
tering the homeless shelter system which is a lifeline for many vulner-
able New Yorkers.

EFFECTIVE DATE:
This act shall take effect one year after it shall have become a law.
Effective immediately, the addition, amendment and/or repeal of any rule
or regulation necessary for the implementation of this act on its effec-
tive date are authorized to be made and completed on or before such
effective date.

 AN ACT to amend the administrative code of the  city  of  New  York,  in
   relation to requiring a process for notification of new homeless shel-
   ters  and  conducting  a  public  information session in the community
   where the proposed shelter is to be located
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  21-324 of the administrative code of the city of
 New York, as added by a chapter of the laws of 2020 amending the  admin-
 istrative  code  of the city of New York relating to requiring new home-
 less shelters conduct a  public  hearing  in  the  community  where  the
 proposed  shelter  is  to  be located before being sited, as proposed in
 legislative bills numbers S.  7215-A and A. 7820-A, is amended  to  read
 as follows:
   § 21-324 Community involvement. a. Notwithstanding any other provision
 of law to the contrary, the department shall establish a process for the
 [siting]  NOTIFICATION of new homeless shelters [for adults], other than
 short-term emergency homeless shelters. SUCH NOTIFICATION SHALL  INCLUDE
 ELECTED  OFFICIALS AND THE COMMUNITY BOARD FOR THE DISTRICT IN WHICH THE
 PROPOSED SHELTER IS TO BE SITED. SUCH PROCESS SHALL ALSO INCLUDE SENDING
 A NOTICE ANNUALLY DURING THE FIRST QUARTER OF EACH CALENDAR YEAR,  ELEC-
 TRONICALLY AND PHYSICALLY, TO FEDERAL, STATE AND LOCAL ELECTED OFFICIALS
 REQUESTING POTENTIAL LOCATIONS FOR HOMELESS SHELTERS. SUCH PROCESS SHALL
 BE POSTED PUBLICLY ON THE AGENCY'S WEBSITE.
   b.  The  process  developed by the department under this section shall
 ALSO include  conducting  at  least  one  public  [hearing]  INFORMATION
 SESSION  on the siting of any new homeless shelter. THE DEPARTMENT SHALL
 PROVIDE NOTICE TO THE PUBLIC OF SUCH INFORMATION SESSIONS ON ITS WEBSITE
 NO LATER THAN FOURTEEN DAYS BEFORE THE  DATE  SUCH  SESSION  IS  SET  TO
 OCCUR.  Such  public [hearings] INFORMATION SESSION shall be held in the

 community district in which such proposed  homeless  shelter  is  to  be
 located AND SHALL ALLOW THE PUBLIC TO ASK QUESTIONS AND SUBMIT COMMENTS.
 SUCH  INFORMATION SESSION SHALL NOT BE CONDUCTED IN A MANNER THAT DELAYS
 THE SITING OF THE PROPOSED SHELTER.
   §  2.  This  act  shall  take  effect on the same date and in the same
 manner as a chapter of the laws of 2020 amending the administrative code
 of the city of New York relating  to  requiring  new  homeless  shelters
 conduct  a public hearing in the community where the proposed shelter is
 to be located before being  sited,  as  proposed  in  legislative  bills
 numbers S. 7215-A and A. 7820-A, takes effect.
