TITLE OF BILL:

An act to amend the economic development law, in relation to establish-
ing the New York state advisory council on coronavirus economic recovery
and workforce development; and providing for the repeal of such
provisions upon expiration thereof

 
SUMMARY OF PROVISIONS:

Economic Development Law is amended by adding a new article 23 hereby
creating the New York State Advisory Council on Coronavirus Economic
Recovery and Workforce Development.The Advisory Council is a 12-member
committee concerned with the issues of coronavirus economic recovery as
well as issues impacting businesses post recovery. As constructed the
Senate and Assembly each have 3 appointments, with the Governor having 6
(two must be small business owners. The members are to represent various
geographic areas and have knowledge of business, education, workforce
development, or public-private partnership for economic recovery.

The council shall make recommendations to the commissioner to include
but not be limited by, opportunities for collaboration between employers
and educational institutions, strategies to address any skills gaps,
strategies to create sustainable pathways into careers, and strategies
for workplace learning and skills application.  Council shall meet as
frequently as is required, and shall receive no compensation. The coun-
cil shall submit a report annually.

 
JUSTIFICATION:

The Coronavirus has created significant upheaval to New York businesses.
New York is currently undertaking steps to assist, but there is a
continuing need for more and increased help.Some of these effects are
immediately known, while others can just be speculated on how they will
manifest in the future. This legislation simply creates a working group
tasked with keeping their finger on the pulse on current and possible
future issues that will affect business here in New York. This 12 person
working group will be tasked with having open and honest dialogue on
what possible solutions to current and future problems will be. The
gravity of the true impact of COVID-19 long lasting impact on New York's
economy is something that needs to be continuously monitored and
reported on by those who have the greatest understanding, and most
significant impact.

 AN  ACT to amend the economic development law, in relation to establish-

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The economic development law is amended  by  adding  a  new
 article 23 to read as follows:
                                ARTICLE 23
          NEW YORK STATE ADVISORY COUNCIL ON CORONAVIRUS ECONOMIC
                    RECOVERY AND WORKFORCE DEVELOPMENT
 SECTION 455. NEW  YORK  STATE  ADVISORY  COUNCIL ON CORONAVIRUS ECONOMIC
                RECOVERY AND WORKFORCE DEVELOPMENT ESTABLISHED.
   § 455. NEW YORK STATE ADVISORY COUNCIL ON CORONAVIRUS ECONOMIC  RECOV-
 ERY  AND  WORKFORCE  DEVELOPMENT ESTABLISHED. 1. THERE IS HEREBY CREATED
 WITHIN THE DEPARTMENT THE NEW YORK STATE ADVISORY COUNCIL ON CORONAVIRUS
 ECONOMIC RECOVERY AND WORKFORCE DEVELOPMENT FOR ADVISING THE  DEPARTMENT
 AS  PROVIDED  IN  THIS  SECTION.   THE COUNCIL SHALL CONCENTRATE BOTH ON
 CORONAVIRUS ECONOMIC RECOVERY AS WELL AS ISSUES IMPACTING BUSINESS  POST
 RECOVERY.
   2.  (A)  THE  COUNCIL  SHALL  CONSIST OF TWELVE MEMBERS: THREE MEMBERS
 APPOINTED BY THE  TEMPORARY  PRESIDENT  OF  THE  SENATE,  THREE  MEMBERS
 APPOINTED  BY THE SPEAKER OF THE ASSEMBLY, AND THE SIX REMAINING MEMBERS
 APPOINTED BY THE GOVERNOR, AT LEAST TWO OF WHICH SHALL BE SMALL BUSINESS
 OWNERS IN THE STATE WHO EMPLOY FIFTY OR LESS EMPLOYEES.
   (B) THE APPOINTED COUNCIL MEMBERS SHALL REPRESENT  VARIOUS  GEOGRAPHIC
 AREAS  OF  THE  STATE  AND SHALL BE KNOWLEDGEABLE IN AT LEAST ONE OF THE
 FOLLOWING AREAS:

   (I) BUSINESS;
   (II) EDUCATION;
   (III) WORKFORCE DEVELOPMENT; OR
   (IV) PUBLIC-PRIVATE PARTNERSHIPS FOR ECONOMIC RECOVERY.
   3.  THE  COUNCIL  SHALL  MAKE  RECOMMENDATIONS  TO THE COMMISSIONER ON
 CERTAIN SUBJECTS INCLUDING, BUT NOT LIMITED TO:
   (A) OPPORTUNITIES FOR COLLABORATION BETWEEN EMPLOYERS AND  EDUCATIONAL
 INSTITUTIONS;
   (B) STRATEGIES TO ADDRESS ANY SKILLS GAPS;
   (C) STRATEGIES TO CREATE SUSTAINABLE PATHWAYS INTO CAREERS; AND
   (D) STRATEGIES FOR WORKPLACE LEARNING AND SKILLS APPLICATION.
   4.  THE  COUNCIL SHALL MEET AS FREQUENTLY AS ITS BUSINESS MAY REQUIRE.
 THE PRESENCE OF A MAJORITY OF THE MEMBERS SHALL CONSTITUTE A QUORUM. THE
 MEMBERS OF THE COUNCIL SHALL RECEIVE NO COMPENSATION FOR THEIR  SERVICES
 AS MEMBERS.
   5.  THE  COMMISSION,  UPON  REQUEST OF THE COUNCIL, SHALL DESIGNATE AN
 OFFICER OR EMPLOYEE OF THE OFFICE TO ACT AS SECRETARY OF THE COUNCIL AND
 SHALL ASSIGN FROM TIME TO TIME SUCH OTHER EMPLOYEES AS THE  COUNCIL  MAY
 REQUIRE.
   6.  THE COUNCIL SHALL DEVELOP AND SUBMIT A REPORT TO THE GOVERNOR, THE
 SPEAKER OF THE ASSEMBLY, AND THE TEMPORARY PRESIDENT OF  THE  SENATE  NO
 LATER  THAN  ONE  YEAR  FROM THE EFFECTIVE DATE OF THIS ACT AND ANNUALLY
 THEREAFTER. SUCH REPORT SHALL INCLUDE RECOMMENDATIONS REQUIRED  BY  THIS
 SECTION  AND  RECOMMENDATIONS  TO  EFFECTIVELY  IMPLEMENT ANY INITIATIVE
 IDENTIFIED BY THE COUNCIL.
   § 2. This act shall take effect immediately and shall  expire  and  be
 deemed repealed four years after it shall have become a law.

   § 455. NEW YORK STATE ADVISORY COUNCIL ON CORONAVIRUS ECONOMIC  RECOV-
 ERY  AND  WORKFORCE  DEVELOPMENT.  1. THERE IS HEREBY CREATED WITHIN THE
 DEPARTMENT THE NEW YORK STATE ADVISORY COUNCIL ON  CORONAVIRUS  ECONOMIC
 RECOVERY  AND  WORKFORCE  DEVELOPMENT  FOR  ADVISING  THE  DEPARTMENT AS
 PROVIDED IN THIS SECTION.  THE COUNCIL SHALL CONCENTRATE BOTH ON CORONA-
 VIRUS ECONOMIC RECOVERY AS WELL AS ISSUES IMPACTING BUSINESS POST RECOV-
 ERY.
   2. (A) THE COUNCIL SHALL CONSIST OF FOURTEEN  MEMBERS:  THREE  MEMBERS
 APPOINTED  BY  THE  TEMPORARY  PRESIDENT  OF  THE  SENATE, THREE MEMBERS
 APPOINTED BY THE SPEAKER OF THE ASSEMBLY, ONE MEMBER  APPOINTED  BY  THE

 CERTAIN SUBJECTS INCLUDING, BUT NOT LIMITED TO:
   (A) OPPORTUNITIES FOR COLLABORATION BETWEEN EMPLOYERS AND  EDUCATIONAL
 INSTITUTIONS;
   (B) STRATEGIES TO ADDRESS ANY SKILLS GAPS;
   (C) STRATEGIES TO CREATE SUSTAINABLE PATHWAYS INTO CAREERS; AND
   (D) STRATEGIES FOR WORKPLACE LEARNING AND SKILLS APPLICATION.
   4.  THE  COUNCIL SHALL MEET AS FREQUENTLY AS ITS BUSINESS MAY REQUIRE,
 BUT NOT LESS THAN TWICE A YEAR.   THE PRESENCE  OF  A  MAJORITY  OF  THE
 MEMBERS  SHALL  CONSTITUTE  A  QUORUM.  THE MEMBERS OF THE COUNCIL SHALL
 RECEIVE NO COMPENSATION FOR THEIR SERVICES AS MEMBERS.
   5. THE COMMISSIONER, UPON REQUEST OF THE COUNCIL, SHALL  DESIGNATE  AN
 OFFICER OR EMPLOYEE OF THE OFFICE TO ACT AS SECRETARY OF THE COUNCIL AND
 SHALL  ASSIGN  FROM TIME TO TIME SUCH OTHER EMPLOYEES AS THE COUNCIL MAY
 REQUIRE.
   6. THE COUNCIL SHALL DEVELOP AND SUBMIT A REPORT TO THE GOVERNOR,  THE
 SPEAKER  OF  THE  ASSEMBLY, AND THE TEMPORARY PRESIDENT OF THE SENATE NO
 LATER THAN ONE YEAR FROM THE EFFECTIVE DATE OF  THIS  ACT  AND  ANNUALLY
 THEREAFTER.  SUCH  REPORT SHALL INCLUDE RECOMMENDATIONS REQUIRED BY THIS
 SECTION AND RECOMMENDATIONS  TO  EFFECTIVELY  IMPLEMENT  ANY  INITIATIVE
 IDENTIFIED BY THE COUNCIL.
   §  2.  This  act shall take effect immediately and shall expire and be
 deemed repealed four years after it shall have become a law.

SUMMARY OF PROVISIONS:

Economic Development Law is amended by adding a new article 23 hereby
creating the New York State Advisory Council on Coronavirus Economic
Recovery and Workforce Development. The Advisory Council is a 16-member,
committee concerned with the issues of coronavirus economic recovery as
well as issues impacting businesses post recovery. As constructed the
Temporary President of the Senate and Assembly Speaker each have 3
appointments, Senate Minority and Assembly Minority Leader each have 1
appointment, and the Governor has 8 appointments (two must be small
business owners). The members are to represent various geographic areas
and have knowledge of business, education, workforce development, or
public-private partnership for economic recovery.

The council shall make recommendations to the commissioner to include
but not be limited by, opportunities for collaboration between employers
and educational institutions, strategies to address any skills gaps,
strategies to create sustainable pathways into careers, and strategies
for workplace learning and skills application. Council shall meet as
frequently as is required but not less than twice a year, and shall
receive no compensation. The council shall submit a report annually.

 
JUSTIFICATION:

The Coronavirus has created significant upheaval to New York businesses.
New York is currently undertaking steps to assist, but there is a
continuing need for more and increased help. Some of these effects are
immediately known, while others can just be speculated on how they will
manifest in the future. This legislation simply creates a working group
tasked with keeping their finger on the pulse on current and possible
future issues that will affect business here in New York. This 12 person
working group will be tasked with having open and honest dialogue on
what possible solutions to current and future problems will be. The
gravity of the true impact of COVID-19 long lasting impact on New York's
economy is something that needs to be continuously monitored and
reported on by those who have the greatest understanding, and most
significant impact.
