BILL NUMBER: S396 SPONSOR: OBERACKER TITLE OF BILL: An act relating to legalizing, validating, ratifying and confirming a transportation contract of the Oneonta city school district PURPOSE: To correct an oversight in the application process for the district's transportation aid for the 2019-2020 school year, when the district did not file its application for transportation aid to the state education department in a timely fashion. SUMMARY OF PROVISIONS: Section 1 validates and ratifies the district's actions with regard to its application for reimbursement for transportation expenses. Section 2 directs the state education department to consider the district's appli- cation as timely and proper. Section 3 provides the effective date.

OBERACKER -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT relating to legalizing, validating, ratifying and confirming a transportation contract of the Oneonta city school district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. All the acts done and proceedings heretofore had and taken or caused to be had and taken by the Oneonta City School District and by all officers, employees or agents of such school district relating to or in connection with transportation contract between the Oneonta City school district and Birnie Bus Services, Inc. for the 2019-2020 school year, and all acts incidental hereto are hereby legalized, validated, ratified and confirmed, notwithstanding any failure to comply with the contract award, approval and filing provisions of the education law, the general municipal law or any other law or any other statutory authority, rule or regulation, other than those filing provisions defined in para- graph a of subdivision 5 of section 3604 of the education law, in relation to any omission, error, defect, irregularity or illegality in such proceeding had and taken. § 2. The department of education is hereby directed to consider the aforementioned contract for transportation aid as valid and proper obli- gations of the Oneonta City School District. § 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD03108-01-1
