BILL NUMBER: S4716 SPONSOR: HOYLMAN TITLE OF BILL: An act to amend the state technology law, in relation to requiring the office of information technology services to cooperate with other state agencies in the implementation of language translation technology PURPOSE: To ensure that New York State agency websites, and particularly those that offer information about COVID-19 or programs, benefits or services related to COVID-19, are easily translatable into the most common non- English languages spoken by New Yorkers. SUMMARY OF PROVISIONS: Section 1 of the bill amends section 101 of the State Technology Law by adding definitions of "state agency," "state agency website," and "user" for the purposes of Article 1 ("Office of Information Technology

HOYLMAN -- read twice and ordered printed, and when printed to be committed to the Committee on Internet and Technology AN ACT to amend the state technology law, in relation to requiring the office of information technology services to cooperate with other state agencies in the implementation of language translation technolo- gy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 101 of the state technology law is amended by adding three new subdivisions 6, 7 and 8 to read as follows: 6. "STATE AGENCY" MEANS AGENCY AS USED UNDER SUBDIVISION ONE OF SECTION NINETY-TWO OF THE PUBLIC OFFICERS LAW. 7. "STATE AGENCY WEBSITE" MEANS AN INTERNET WEBSITE OPERATED BY OR FOR A STATE AGENCY. SUCH TERM SHALL INCLUDE THOSE WEBSITES OPERATED ON BEHALF OF STATE AGENCIES BY OTHER PUBLIC OR PRIVATE ENTITIES, BUT SHALL NOT INCLUDE ANY PORTIONS OF THE INTERNET OUTSIDE THE CONTROL OF THE STATE AGENCY. 8. "USER" MEANS ANY NATURAL PERSON WHO USES THE INTERNET TO ACCESS A STATE AGENCY WEBSITE. § 2. Section 103 of the state technology law is amended by adding a new subdivision 8-a to read as follows: 8-A. (A) TO ADVISE AND ASSIST STATE AGENCIES IN THE IMPLEMENTATION OF LANGUAGE TRANSLATION TECHNOLOGY ON STATE AGENCY WEBSITES CONTAINING INFORMATION ABOUT THE NOVEL CORONAVIRUS ("COVID-19") OR PROGRAMS, BENE- FITS OR SERVICES RELATED TO COVID-19 WITHIN THIRTY DAYS OF THE EFFECTIVE DATE OF THIS SUBDIVISION; AND ON ALL OTHER STATE AGENCY WEBSITES WITHIN NINETY DAYS OF THE EFFECTIVE DATE OF THIS SUBDIVISION. (B) SUCH LANGUAGE TRANSLATION TECHNOLOGY SHALL, AT A MINIMUM, ALLOW USERS TO TRANSLATE THE TEXT OF STATE AGENCY WEBSITES INTO AT LEAST THE TWELVE MOST COMMON NON-ENGLISH LANGUAGES SPOKEN BY INDIVIDUALS WITH LIMITED-ENGLISH PROFICIENCY IN THE STATE OF NEW YORK, BASED ON UNITED STATES CENSUS DATA. § 3. This act shall take effect immediately.
