   printed to be committed to the Committee on Judiciary
 
 AN ACT to amend the real property law, in relation to allowing  acknowl-
   edgments  and  proofs  by  any  commissioned officer in active service
   authorized to act as a notary

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The opening paragraph of section 300 of the real property
 law, as amended by chapter 977 of the laws of 1962, is amended  to  read
 as follows:
   The  acknowledgment  or proof of a conveyance of real property situate
 in this state, if made by a person enlisted or commissioned in or  serv-
 ing  in  or with the armed forces of the United States or by a dependent
 of any such person, wherever located, or by  a  person  attached  to  or
 accompanying  the armed forces of the United States, whether made within
 or without the United States, may be made before any commissioned  offi-
 cer in active service of the armed forces of the United States [with the
 rank  of  second  lieutenant  or higher in the Army, Air Force or Marine
 Corps, or ensign or higher in the Navy or Coast Guard,  or  with  equiv-
 alent  rank] AUTHORIZED TO ACT AS A NOTARY in any [other] component part
 of the armed forces of the United States.
   § 2. This act shall take effect immediately.
