 Introduced  by Sen. BRISPORT -- read twice and ordered printed, and when
   printed to be committed to the Committee on Children and Families
 
 AN ACT to amend the social services law, in relation to requiring  local
   social  service  districts  to  offer to pay childcare providers via a
   direct deposit for any subsidized child care funds owed

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 390-c of the social services law, as added by chap-
 ter 460 of the laws of 2000, is amended by adding a new subdivision 4 to
 read as follows:
   4.  THE COMMISSIONER OF CHILDREN AND FAMILY SERVICES IS AUTHORIZED AND
 DIRECTED, NO LATER THAN ONE YEAR FROM THE EFFECTIVE DATE OF THIS  SUBDI-
 VISION, TO PROMULGATE RULES AND REGULATIONS TO REQUIRE THAT LOCAL SOCIAL
 SERVICE  DISTRICTS OFFER CHILD DAY CARE PROVIDERS, AS DEFINED IN SECTION
 THREE HUNDRED NINETY OF THIS TITLE, THE OPTION TO  BE  PAID  ANY  MONIES
 OWED  FOR  PROVIDING  SUBSIDIZED CHILD CARE BY A DEPOSIT DIRECTLY INTO A
 BANK ACCOUNT OF THE CHILD DAY CARE PROVIDER. SUCH DIRECT  DEPOSIT  SHALL
 ONLY BE MADE AT THE EXPRESS WRITTEN CONSENT OF THE PROVIDER AND SHALL BE
 REQUESTED  ON  FORMS  PROVIDED BY THE LOCAL SOCIAL SERVICES DISTRICT AND
 DULY FILLED IN BY THE PROVIDER. SUCH WRITTEN CONSENT CAN BE  REVOKED  AT
 ANY  TIME  BY  THE  PROVIDER  IN  WRITING ON FORMS PROVIDED BY THE LOCAL
 SOCIAL SERVICES DISTRICT.
   § 2. This act shall take effective immediately.
