TITLE OF BILL:

An act to amend the social services law, in relation to requiring local
social service districts to offer to pay childcare providers via a
direct deposit for any subsidized child care funds owed

 
SUMMARY OF PROVISIONS:

Section 1 of the bill amends section 390-c of the social services law to
authorize and direct the Commissioner of the Office of Children and
Family Services to issue a regulation within one year of the effective
date of this section to require that local social service districts
create an option for child care providers to be paid for any child care
subsidy funding owed via a direct deposit.

JUSTIFICATION:

This legislation will give child care providers who receive subsidy
payments from a local social services district the option to be paid by
a direct deposit. This will create a more streamlined system for both
the provider and the district.

Under the current system, a provider submits documentation to the county
in order to get paid for care provided to children in their program that
are eligible for a child care subsidy. They then wait, sometimes more
than four weeks, for their payment from the county. In addition, the
delivery of their mail is delayed during high volume mail periods, lost
mail, or having mail stolen from a mailbox. They then have to wait even
longer for a new check to be issued, which is hard for a provider who is
already living paycheck to paycheck.  Many of the providers who receive
subsidy funds from local social services districts live in communities
that are traditionally underserved by banks. The lack of access to
financial institutions creates a burden for these individuals to deposit
their checks.  Instead, they may turn to other entities that are in
their neighborhood, such as check cashing centers, that charges higher
rates and fees.

Lastly, this legislation will create savings for local social service
districts by eliminating the need to issue paper checks and the time
associated with such tasks.

 AN ACT to amend the social services law, in relation to requiring  local
   social  service  districts  to  offer to pay childcare providers via a
   direct deposit for any subsidized child care funds owed

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 390-c of the social services law, as added by chap-
 ter 460 of the laws of 2000, is amended by adding a new subdivision 4 to
 read as follows:
   4.  THE COMMISSIONER OF CHILDREN AND FAMILY SERVICES IS AUTHORIZED AND
 DIRECTED, NO LATER THAN ONE YEAR FROM THE EFFECTIVE DATE OF THIS  SUBDI-
 VISION, TO PROMULGATE RULES AND REGULATIONS TO REQUIRE THAT LOCAL SOCIAL
 SERVICE  DISTRICTS OFFER CHILD DAY CARE PROVIDERS, AS DEFINED IN SECTION
 THREE HUNDRED NINETY OF THIS TITLE, THE OPTION TO  BE  PAID  ANY  MONIES
 OWED  FOR  PROVIDING  SUBSIDIZED CHILD CARE BY A DEPOSIT DIRECTLY INTO A
 BANK ACCOUNT OF THE CHILD DAY CARE PROVIDER. SUCH DIRECT  DEPOSIT  SHALL
 ONLY BE MADE AT THE EXPRESS WRITTEN CONSENT OF THE PROVIDER AND SHALL BE
 REQUESTED  ON  FORMS  PROVIDED BY THE LOCAL SOCIAL SERVICES DISTRICT AND
 DULY FILLED IN BY THE PROVIDER. SUCH WRITTEN CONSENT CAN BE  REVOKED  AT
 ANY  TIME  BY  THE  PROVIDER  IN  WRITING ON FORMS PROVIDED BY THE LOCAL
 SOCIAL SERVICES DISTRICT.
   § 2. This act shall take effective immediately.
