TITLE OF BILL:

An act to authorize the Manhasset union free school district and Manhas-
set public library to take certain actions to correct an understatement
in the certification of the 2020-2021 tax levy of the such library

 
PURPOSE:

To correct a clerical error in the understatement of the certification
of the 2020-2021 tax levy as it relates to the Manhasset public library,
to ensure the full amount previously approved by the libraries eligible
voters is made available to the library.

 
SUMMARY OF SPECIFIC PROVISIONS:

The approved budget of the Manhasset Public Library for FY 2020-2021
required raising $5,403,412 in taxes.  In certifying the amount of the
taxes to be levied on behalf of the Library during such year, the

Manhasset Union Free School District mistakenly omitted the sum of
$1,022,625 due to a clerical error.  Accordingly, if left uncorrected,
there will be a shortfall or understatement in the amount of $1,022,625
in taxes levied and collected for such year on behalf of the Library.

This act corrects the understatement and authorizes the levy and
collection of the full amount of the Library's voter approved and
lawfully authorized taxes for such fiscal year.

The act authorizes the collection of the FY 2020-2021 understatement in
the following FY 2021-2022. Accordingly, over the two-year period,
taxpayers would pay exactly the same amount that they have authorized to
be raised by taxes. The collection of a portion of that amount would be
delayed to the FY 2021-2022 rather than being collected during the year
for which it was authorized. The legislation further authorizes the
School District to advance to the Library the amount of the understate-
ment that should have been raised during FY 2020-2021 and be reimbursed
when later is collected in FY 20212022.  Finally, the legislation
provides that the Library's tax levy limit should be calculated as if
the understatement had not occurred.

 
JUSTIFICATION:

This legislation would merely authorize the collection of a portion of
the taxes authorized to be levied on behalf of the Manhasset Public
Library during FY 2020-2021 to be raised during the following fiscal
year, FY 2021-2022. Over the two fiscal years, taxpayers would pay
exactly the same amount they would have paid if the error did not occur.
The will and intent of the voters is being effectuated, upheld and main-
tained through adoption of this legislation. The taxpayers have previ-
ously authorized this levy and collection of taxes in the amount of
$5,403,412 during FY 2020-2021 and expect services provided by Manhasset
Public Library commensurate with the authorized levy.

In the absence of this act, the Manhasset Public Library, through no
fault of its own, would be significantly harmed. The Library would be
deprived of the sum of $1,022,625 authorized to be raised on its behalf
by taxes - or close to 20% of its tax support for the year.

 AN ACT to authorize the Manhasset union free school district and Manhas-
   set public library to take certain actions to correct  an  understate-
   ment  in  the  certification  of  the  2020-2021  tax levy of the such
   library
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Notwithstanding any provision of law to the contrary, the
 Manhasset union free school district is hereby authorized and  empowered
 to  take  any  and all actions necessary and required to: (a) include in
 its certification of the amount  of  taxes  required  to  be  levied  to
 support  the  approved  fiscal  year  2021-2022  budget of the Manhasset
 public library the additional sum of $1,022,625 that, but for a clerical
 error in the amount certified to be levied for  fiscal  year  2020-2021,
 should have been levied in fiscal year 2020-2021 to support the approved
 fiscal  year  2020-2021  budget  of  the Manhasset public library, which
 resulted in a fiscal year 2020-2021 tax levy  of  the  Manhasset  public
 library  in  the amount of $5,403,412, inclusive of said understatement;
 (b) to pay the amount of the full operating budget and debt service  due
 in fiscal year 2020-2021 to or on behalf of the Manhasset public library
 in the total amount of $5,403,412, inclusive of said understatement; and
 (c) retain as reimbursement from the taxes to be levied and collected in
 fiscal year 2021-2022 an amount equal to said understatement.
   §  2. Notwithstanding any provision of law to the contrary, for fiscal
 year 2021-2022 the Manhasset public library  is  hereby  authorized  and
 empowered  to calculate and reflect for all purposes its tax levy limit,
 as such term is defined in section 3-c of  the  general  municipal  law,
 based  upon its authorized fiscal year 2020-2021 tax levy of $5,403,412,
 which authorized fiscal year 2020-2021 tax  levy  is  inclusive  of  the
 amount of said understatement; and for fiscal year 2022-2023 the Manhas-

 set  public  library is hereby authorized and empowered to calculate and

 tax levy is to be exclusive of the amount of said understatement.
