 AN ACT directing the department of labor  to  conduct  a  study  on  the
   employment  rate  of  Black and Latinx transgender persons in New York
   state

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. 1. The department of labor, in consultation with the divi-
 sion of human rights, is hereby authorized and  directed  to  conduct  a
 study  on the employment rate of Black and Latinx transgender persons in
 New York state. The purpose of such study shall be:
   (a) to provide current data on the employment rate of Black and Latinx
 transgender persons in the state and additionally in each county and  in
 the city of New York;
   (b)  to  determine  whether  a disparity exists between the employment
 rate for Black and Latinx transgender persons and  the  employment  rate
 for  other  persons in the state, and if so, the factors contributing to
 such disparity;
   (c) to determine whether and to what extent discrimination  and  other
 barriers  affect  the  employment  rate for Black and Latinx transgender
 persons; and
   (d) to determine what changes, if any, should be made to  state  poli-
 cies  affecting  the  employment  rate  for Black and Latinx transgender
 persons, and recommend any legislation, rules or  regulations  it  deems
 necessary  to improve the employment rate and expand employment opportu-
 nities for such persons.
   2. The department of labor shall issue a report of  its  findings  and
 recommendations  to  the  governor,  the speaker of the assembly and the
 temporary president of the senate and shall publish such report  on  its
 website within one year after the effective date of this act.
   § 2. This act shall take effect immediately.

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. 1. The department of labor, in consultation with the divi-
 sion of human rights, is hereby authorized and  directed  to  conduct  a
 study  on  the employment rate of transgender persons in New York state.
 The purpose of such study shall be:
   (a) to provide current data on  the  employment  rate  of  transgender
 persons  in the state and additionally in each county and in the city of
 New York;
   (b) to determine whether a disparity  exists  between  the  employment
 rate  for  transgender persons and the employment rate for other persons
 in the state, and if so, the factors contributing to such disparity;
   (c) to determine whether and to what extent discrimination  and  other
 barriers affect the employment rate for transgender persons; and
   (d)  to  determine what changes, if any, should be made to state poli-
 cies affecting the employment rate for transgender persons,  and  recom-
 mend any legislation, rules or regulations it deems necessary to improve
 the  employment  rate  and  expand  employment  opportunities  for  such
 persons; and
   (e) to provide specific data and analysis on the findings  from  para-
 graphs (a) through (d) of this section as such findings relate to racial
 and  ethnic  characteristics,  including  but  not  limited to Black and
 Latinx transgender persons.
   2. The department of labor shall issue a report of  its  findings  and
 recommendations  to  the  governor,  the speaker of the assembly and the
 temporary president of the senate and shall publish such report  on  its
 website within one year after the effective date of this act.
   § 2. This act shall take effect immediately.
