TITLE OF BILL:

An act to amend the public health law, in relation to establishing the
eating disorders in children task force

 
PURPOSE:

To establish an eating disorders in children task force.

 
SUMMARY OF PROVISIONS:

Section 1 adds a new section to the public health law, 2500-m, requiring
the commissioner to convene a task force to study and create guidelines,
best practices, and a standardized approach for the early screening of
eating disorders in children. Section 1 also provides that the task
force shall be chaired by the commissioner or an employee of the depart-
ment as selected by the commissioner. Further, the membership of the
task force may also include representatives from other state agencies,

community agencies, hospitals, and other entities dedicated to studying
or providing services to children with eating disorders.  The task force
must include one representative from each New York chapter of the Ameri-
can Academy of Pediatrics, for which there are three.

Section 2. Establishes an effective date.

 
JUSTIFICATION:

Currently, there is no standardized screening approach for the early
identification of eating disorders. Screening is a way to detect a
disorder before the onset of symptoms. Early detection may prevent
psychological or physical concerns of malnutrition that may lead to
other health consequences. Early treatment of eating disorders can have
a significantly positive impact on the health and well-being of children
and adolescents.

To promote and improve the early identification of eating disorders, the
American Academy of Pediatrics (AAP) published a report in 2003 that
recommends screening for eating disorders on an annual basis.  Despite
these recommendations, there is no data on how or if pediatricians are
consistently screening for eating disorders. Nor is there data to indi-
cate that pediatricians are applying the same diagnostic criteria. To
address this issue, this bill will require the Department of Health to
engage with relevant stakeholders to create a standardized approach to
screening for eating disorders in children while also developing best
practices and guidelines for implementation.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public health law is amended by adding  a  new  section
 2500-m to read as follows:
   § 2500-M. EATING DISORDERS IN CHILDREN TASK FORCE. 1. THE COMMISSIONER
 SHALL  CONVENE  AN  EATING DISORDERS IN CHILDREN TASK FORCE TO STUDY AND
 CREATE A STANDARDIZED APPROACH TO, AND DEVELOP BEST PRACTICES AND GUIDE-
 LINES FOR SCREENING EATING DISORDERS IN CHILDREN.
    2. THE TASK FORCE SHALL BE CHAIRED BY THE  COMMISSIONER  OR  BY  SUCH
 OFFICER  OR  EMPLOYEE  OF  THE  DEPARTMENT AS SHALL BE DESIGNATED BY THE
 COMMISSIONER. THE MEMBERSHIP OF THE TASK  FORCE  MAY  INCLUDE  REPRESEN-
 TATION FROM APPROPRIATE STATE AGENCIES AND MEMBERS THAT REPRESENT COMMU-
 NITY  AGENCIES, HOSPITALS, OR OTHER ENTITIES DEDICATED TO RESEARCHING OR
 PROVIDING SERVICES TO CHILDREN WITH EATING  DISORDERS.  THE  TASK  FORCE
 SHALL  INCLUDE THE FOLLOWING MEMBERS, TO BE APPOINTED BY THE COMMISSION-
 ER:
   (A) ONE REPRESENTATIVE FROM NEW YORK CHAPTER ONE OF THE AMERICAN ACAD-
 EMY OF PEDIATRICS;
   (B) ONE REPRESENTATIVE FROM NEW YORK CHAPTER TWO OF THE AMERICAN ACAD-
 EMY OF PEDIATRICS; AND
   (C) ONE REPRESENTATIVE FROM NEW YORK CHAPTER  THREE  OF  THE  AMERICAN
 ACADEMY OF PEDIATRICS.
   3.  SUCH TASK FORCE SHALL ESTABLISH RECOMMENDATIONS, FOR USE BY PEDIA-
 TRIC PRIMARY CARE PROVIDERS, FOR BEST PRACTICE PROTOCOLS AND  GUIDELINES
 FOR  EARLY  SCREENING  OF  CHILDREN  FOR EATING DISORDERS, AS DEFINED BY
 SUBDIVISION (A) OF SECTION 30.02 OF THE MENTAL HYGIENE LAW. SUCH  RECOM-
 MENDATIONS SHALL INCORPORATE THE STANDARDS AND GUIDELINES ESTABLISHED BY
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

 THE  AMERICAN  ACADEMY  OF  PEDIATRICS, BUT SHALL NOT BE LIMITED TO SUCH
 STANDARDS AND GUIDELINES.
   4.  THE COMMISSIONER SHALL PROMULGATE ANY RULES AND REGULATIONS NECES-
 SARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION.
   5. THE TASK FORCE SHALL PROVIDE AN INITIAL REPORT TO THE GOVERNOR  AND
 THE LEGISLATURE OF ITS FINDINGS, CONCLUSIONS, RECOMMENDATIONS AND ACTIV-
 ITIES  ALREADY  UNDERTAKEN  BY  THE  TASK FORCE, NOT LATER THAN ONE YEAR
 AFTER THE EFFECTIVE DATE OF THIS SECTION, AND  SHALL  PROVIDE  A  REPORT
 EVERY TWO YEARS THEREAFTER WITH UPDATED FINDINGS, CONCLUSIONS AND RECOM-
 MENDATIONS  AND  SHALL  SUBMIT  WITH  SUCH  BIENNIAL  REPORT LEGISLATIVE
 PROPOSALS AS IT DEEMS NECESSARY TO IMPLEMENT ITS RECOMMENDATIONS.
   § 2. This act shall take effect immediately.

 NUTRITIONISTS AND MENTAL HEALTH PROFESSIONALS WITH  DEMONSTRATED  EXPER-

 ADVOCACY ORGANIZATIONS WORKING TO PREVENT AND  TREAT  EATING  DISORDERS,
 AND OTHER MEMBERS DEEMED NECESSARY BY THE COMMISSIONER.
   (B)  THE  MEMBERS  OF THE TASK FORCE SHALL RECEIVE NO COMPENSATION FOR
 THEIR SERVICES BUT SHALL BE REIMBURSED FOR ACTUAL AND NECESSARY EXPENSES
 INCURRED IN THE PERFORMANCE OF THEIR DUTIES.
   3. SUCH TASK FORCE SHALL ESTABLISH RECOMMENDATIONS, FOR USE BY  PEDIA-
 TRIC  PRIMARY CARE PROVIDERS, FOR BEST PRACTICE PROTOCOLS AND GUIDELINES
 FOR APPROPRIATE SCREENING OF CHILDREN FOR EATING DISORDERS,  AS  DEFINED
 BY  SUBDIVISION  (A)  OF  SECTION  30.02 OF THE MENTAL HYGIENE LAW. SUCH
 RECOMMENDATIONS SHALL INCORPORATE THE STANDARDS  AND  GUIDELINES  ESTAB-

   4. THE TASK FORCE SHALL FURTHER  DEVELOP  RECOMMENDATIONS  FOR  EDUCA-
 TIONAL   AND   INFORMATIONAL   MATERIALS   FOR   SUCH   CHILDREN,  THEIR
 PARENTS/GUARDIANS, AND EDUCATORS REGARDING AWARENESS,  RECOGNITION,  AND
 TREATMENT OF EATING DISORDERS.
   5.  THE COMMISSIONER SHALL PROMULGATE ANY RULES AND REGULATIONS NECES-
 SARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION.
   6. THE TASK FORCE SHALL PROVIDE AN INITIAL  REPORT  TO  THE  GOVERNOR,
 TEMPORARY PRESIDENT OF THE SENATE, MINORITY LEADER OF THE SENATE, SPEAK-
 ER  OF  THE  ASSEMBLY, MINORITY LEADER OF THE ASSEMBLY, THE CHAIR OF THE
 SENATE COMMITTEE ON HEALTH, THE CHAIR OF THE SENATE COMMITTEE ON  MENTAL
 HEALTH, THE CHAIR OF THE SENATE COMMITTEE ON EDUCATION, THE CHAIR OF THE
 ASSEMBLY  COMMITTEE  ON  HEALTH,  THE CHAIR OF THE ASSEMBLY COMMITTEE ON
 MENTAL HEALTH, AND THE CHAIR OF THE ASSEMBLY COMMITTEE ON  EDUCATION  OF
 ITS FINDINGS, CONCLUSIONS, RECOMMENDATIONS AND ACTIVITIES ALREADY UNDER-
 TAKEN  BY  THE  TASK  FORCE, NOT LATER THAN ONE YEAR AFTER THE EFFECTIVE
 DATE OF THIS SECTION, AND SHALL PROVIDE A REPORT EVERY TWO YEARS  THERE-

   (B)  THE  MEMBERS  OF THE TASK FORCE SHALL RECEIVE NO COMPENSATION FOR

 FOR APPROPRIATE SCREENING OF CHILDREN FOR EATING DISORDERS,  AS  DEFINED
 BY  SUBDIVISION  (A)  OF SECTION 30.02 OF THIS ARTICLE. SUCH RECOMMENDA-
 TIONS SHALL INCORPORATE THE STANDARDS AND GUIDELINES ESTABLISHED BY  THE
 AMERICAN  ACADEMY OF PEDIATRICS, BUT SHALL NOT BE LIMITED TO SUCH STAND-
 ARDS AND GUIDELINES.
   4. THE TASK FORCE SHALL FURTHER  DEVELOP  RECOMMENDATIONS  FOR  EDUCA-
 TIONAL   AND   INFORMATIONAL   MATERIALS   FOR   SUCH   CHILDREN,  THEIR
 PARENTS/GUARDIANS, AND EDUCATORS REGARDING AWARENESS,  RECOGNITION,  AND
 TREATMENT OF EATING DISORDERS.
   5.  THE COMMISSIONER SHALL PROMULGATE ANY RULES AND REGULATIONS NECES-
 SARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION.
   6. THE TASK FORCE SHALL PROVIDE AN INITIAL  REPORT  TO  THE  GOVERNOR,
 TEMPORARY PRESIDENT OF THE SENATE, MINORITY LEADER OF THE SENATE, SPEAK-
 ER  OF  THE  ASSEMBLY, MINORITY LEADER OF THE ASSEMBLY, THE CHAIR OF THE
 SENATE COMMITTEE ON HEALTH, THE CHAIR OF THE SENATE COMMITTEE ON  MENTAL
 HEALTH, THE CHAIR OF THE SENATE COMMITTEE ON EDUCATION, THE CHAIR OF THE
 ASSEMBLY  COMMITTEE  ON  HEALTH,  THE CHAIR OF THE ASSEMBLY COMMITTEE ON
 MENTAL HEALTH, AND THE CHAIR OF THE ASSEMBLY COMMITTEE ON  EDUCATION  OF
 ITS FINDINGS, CONCLUSIONS, RECOMMENDATIONS AND ACTIVITIES ALREADY UNDER-
 TAKEN  BY  THE  TASK  FORCE, NOT LATER THAN ONE YEAR AFTER THE EFFECTIVE
 DATE OF THIS SECTION, AND SHALL PROVIDE A REPORT EVERY TWO YEARS  THERE-
 AFTER  WITH  UPDATED FINDINGS, CONCLUSIONS AND RECOMMENDATIONS AND SHALL
 SUBMIT WITH SUCH BIENNIAL  REPORT  LEGISLATIVE  PROPOSALS  AS  IT  DEEMS
 NECESSARY TO IMPLEMENT ITS RECOMMENDATIONS.
   § 2. This act shall take effect immediately.
