BILL NUMBER: S6500 SPONSOR: RYAN TITLE OF BILL: An act to amend the state finance law, in relation to the attorney licensing fund This measure is being introduced at the request of the Judiciary. This measure would amend the State Finance Law to add a new section 94-c to continue the Attorney Licensing Fund and clarify that moneys in the Fund are to be used by the Judiciary to pay the costs of three programs critical to discharge of the court system's statutory obligations regarding bar admission and attorney discipline: i.e., candidate exam- ination (the State Board of Law Examiners), candidate fitness (Commit- tees on Character and Fitness) and attorney discipline. See Judiciary Law §§ 90, 460. The Attorney Licensing Fund was first established in 1990 as part of an amendment to section 468-a(4) of the Judiciary Law. L. 1990, c. 190, § 255. Since 1981, when it was first enacted (L. 1981, c. 714), section 468-a had required each attorney licensed to practice law in New York to register with the Office of Court Administration every two years and, at

RYAN -- (at request of the Office of Court Adminis- tration) -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the state finance law, in relation to the attorney licensing fund THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The state finance law is amended by adding a new section 94-c to read as follows: § 94-C. ATTORNEY LICENSING FUND. 1. THE ATTORNEY LICENSING FUND IS HEREBY CONTINUED IN THE JOINT CUSTODY OF THE STATE COMPTROLLER AND THE COMMISSIONER OF TAXATION AND FINANCE. 2. SUCH FUND SHALL CONSIST OF THAT PORTION OF THE BIENNIAL ATTORNEY REGISTRATION FEE DEPOSITED THEREIN PURSUANT TO SECTION FOUR HUNDRED SIXTY-EIGHT-A OF THE JUDICIARY LAW AND ANY OTHER MONEYS DEPOSITED THERE- IN PURSUANT TO LAW. 3. ALL MONEYS IN THE ATTORNEY LICENSING FUND SHALL BE AVAILABLE, SUBJECT TO APPROPRIATION AND IN ADDITION TO ANY OTHER MONEYS AVAILABLE PURSUANT TO LAW, FOR THE PAYMENT OF SERVICES AND EXPENSES OF THE JUDICI- ARY IN OPERATING ITS CANDIDATE EXAMINATION (STATE BOARD OF LAW EXAMIN- ERS), CANDIDATE FITNESS (COMMITTEES ON CHARACTER AND FITNESS) AND ATTOR- NEY DISCIPLINARY PROGRAMS PURSUANT TO SECTION NINETY OF THE JUDICIARY LAW, INCLUDING LIABILITIES INCURRED IN A PRIOR FISCAL YEAR. 4. ALL PAYMENTS OF MONEYS FROM THE ATTORNEY LICENSING FUND SHALL BE MADE ON THE AUDIT AND WARRANT OF THE COMPTROLLER ON VOUCHERS CERTIFIED AND APPROVED BY THE CHIEF ADMINISTRATOR OF THE COURTS. § 2.
