BILL NUMBER: S6812 SPONSOR: GOUNARDES TITLE OF BILL: An act to amend the estates, powers and trusts law, in relation to allowing a duly appointed personal representative of the estate of a victim of the September eleventh, two thousand one terrorist attacks to file a claim with the September eleventh victim compensation fund PURPOSE OR GENERAL IDEA OF BILL: The proposed legislation would treat the filing and processing by the VCF of a personal injury claim against the VCF of a victim who did not die as a result of his/her injuries the same as a victim who had died as a result of his/her injuries. GOUNARDES -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the estates, powers and trusts law, in relation to allowing a duly appointed personal representative of the estate of a victim of the September eleventh, two thousand one terrorist attacks to file a claim with the September eleventh victim compensation fund THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph 3 of paragraph e of section 11-4.7 of the estates, powers and trusts law, as added by chapter 73 of the laws of 2002, is amended to read as follows: (3) Notwithstanding any other provision of law to the contrary, or any restrictions set forth in letters relating to any decedent who [dies as a result of wounds or injury incurred as a result] IS A VICTIM of the terrorist attacks on September eleventh, two thousand one, a duly appointed personal representative is authorized to file and prosecute a claim with the fund, and the filing of such a claim for an award from the fund, and the resulting compromise of any cause of action pursuant to the act, shall not violate any restriction on the powers granted to the personal representative relating to the prosecution or compromise of any action, the collection of any settlement, or the enforcement of any judgment. § 2.
