BILL NUMBER: S6899 SPONSOR: PALUMBO PURPOSE: To authorize the Town of East Hampton to use any funds that are left remaining after the dissolution of its wastewater disposal district for town-wide capital projects SUMMARY OF PROVISIONS: Section 1. Notwithstanding paragraph (d) of subdivision 12 of Section 198 of the Town Law to the contrary, the town of East Hampton is author- ized to direct proceeds from the dissolution of the East Hampton waste- water disposal district for the purposes of paying all or a portion of the cost of one or more town-wide capital projects. Such authorization shall be the subject of a public hearing held in a manner consistent with Subdivision 12 of Section 198 of the Town Law. Section 2. Effective date.

PALUMBO -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT authorizing the town of East Hampton, county of Suffolk, upon the dissolution of the East Hampton wastewater disposal district, to use any remaining funds of the district for the purposes of paying all or a portion of the cost of one or more town-wide capital projects THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding paragraph (d) of subdivision 12 of section 198 of the town law to the contrary, a resolution of the Town Board for the dissolution of the East Hampton wastewater disposal district ("the district") shall be subject to permissive referendum and the proceeds from the dissolution of the district may be used for the purposes of paying all or a portion of the cost of one or more town-wide capital projects; provided however any such authorizations shall be the subject of a public hearing held in the manner provided in subdivision 12 of section 198 of the town law. If the town board shall decide, after such hearing and upon the evidence given thereat, that it is in the public interest to dissolve the district and upon dissolution to deposit any remaining funds in one or more capital reserve funds in accordance with the general municipal law and use such funds for the purposes of paying all or a portion of the cost of one or more town-wide capital projects, the town board may adopt a resolution, subject to permissive referendum, to authorize such deposit. The town board shall file a copy of said resolutions in the office of the county clerk and the state department of audit and control at Albany, New York. § 2. This act shall take effect immediately.
