BILL NUMBER: S6921 SPONSOR: BRESLIN TITLE OF BILL: An act to amend the public health law, in relation to requiring written, in-person, or electronic notifications to be utilized for registration in the donate life registry PURPOSE OR GENERAL IDEA OF BILL: This bill provides a prioritization of written notice methods for New Yorkers registering in the New York State Donate Life Registry to require, where possible, in-person or electronic notice to those persons. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends paragraph c of subdivision 3 of section 4310 of the public health law, which outlines the requirement of written notifica- tion to registrants in the state's donate life registry, to add provisions requiring the use of either in-person or electronic means of

BRESLIN -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to requiring written, in-person, or electronic notifications to be utilized for registration in the donate life registry THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 3 of section 4310 of the public health law, as added by section 27 of part A of chapter 60 of the laws of 2014, is amended to read as follows: (c) provision of written or electronic notification of registration in the donate life registry to an individual enrolling in the donate life registry; PROVIDED, HOWEVER, THAT WRITTEN, IN-PERSON OR ELECTRONIC NOTIFICATIONS SHALL BE UTILIZED WHEREVER POSSIBLE AS METHODS FOR FULFILLMENT OF THE PURPOSES OF THIS PARAGRAPH; and § 2. Paragraph (c) of subdivision 5 of section 4310 of the public health law, as amended by section 27 of part A of chapter 60 of the laws of 2014, is amended to read as follows: (c) Enrollment or amendment or revocation through the donate life registry website through any of the means listed in this subdivision may be signed by electronic signature, in accordance with the provisions of article three of the state technology law, supported by the use of suit- able mechanisms including unique identifiers to provide confidence in the identity of the person providing the electronic signature. The registration shall take effect upon the provision of written or elec- tronic notice of the registration to the individual enrolling in the donate life registry AND THE REGISTRY'S RECEIPT OF THE INDIVIDUAL'S ENROLLMENT DATA; PROVIDED, HOWEVER, THAT WRITTEN, IN-PERSON OR ELECTRON- IC NOTIFICATIONS SHALL BE UTILIZED WHEREVER POSSIBLE AS METHODS FOR FULFILLMENT OF THE PURPOSES OF THIS PARAGRAPH. § 3.
