BILL NUMBER: S7783 SPONSOR: ADDABBO TITLE OF BILL: An act to amend the agriculture and markets law, in relation to the prohibition of the slaughter of race horses and race horse breeding stock PURPOSE: This is a chapter amendment that makes changes to provisions of L.2021, c.645, to modify liability provisions contained within the legislation SUMMARY OF PROVISIONS: This legislation amends the underlying chapter by providing that race horse owners who can demonstrate that there is proper documentation of a transfer of ownership to a party with no financial or familial relation- ship to the owner shall be shielded from liability with respect to the provisions of this section. In the original legislation, an owner would be held liable unless such owner could demonstrate proper documentation.

ADDABBO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the agriculture and markets law, in relation to the prohibition of the slaughter of race horses and race horse breeding stock THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 6 of section 382 of the agriculture and markets law, as added by a chapter of the laws of 2021 amending the agriculture and markets law relating to the prohibition of the slaughter of race horses and race horse breeding stock; amending the racing, pari-mutuel wagering and breeding law relating to requiring race horses to be micro- chipped; and amending the tax law relating to gifts for thoroughbred and standardbred race horse aftercare, as proposed in legislative bills numbers S. 1442-B and A. 4154-B, is amended to read as follows: 6. Notwithstanding any other provision of law, each and every owner of a race horse that has competed in New York state on or after January first, two thousand twenty-two, or any other horse used for breeding purposes in New York state on or after January first, two thousand twen- ty-two, shall NOT be liable for any violation of this section[, unless] WITH RESPECT TO SUCH HORSE IF SUCH OWNER CAN DEMONSTRATE THAT there is proper documentation of a transfer of ownership[, and that transfer must be] to a party with no financial or familial relationship to the owner. § 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2021 amending the agriculture and markets law relating to the prohibition of the slaughter of race horses and race horse breeding stock; amending the racing, pari-mutuel wagering and breeding law relating to requiring race horses to be microchipped; and amending the tax law relating to gifts for thoroughbred and stan- dardbred race horse aftercare, as proposed in legislative bills numbers S. 1442-B and A. 4154-B, takes effect.
