BILL NUMBER: S7889 SPONSOR: REICHLIN-MELNICK TITLE OF BILL: An act to amend the general business law, in relation to the manufacture of seasonal and decorative lighting products containing lead; and to repeal section 1376-b of the public health law relating thereto PURPOSE: This is a chapter amendment that makes changes to provisions of L.2021, c.634, to move language to General Business Law, clarifies the responsi- ble entities for any violations, and adjusts the penalty amount for violations. SUMMARY OF PROVISIONS: This legislation amends the underlying chapter to create a new article under General Business Law specifically for products containing lead and clarifies that the new statute will apply to products distributed after the effective date. REICHLIN-MELNICK -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the general business law, in relation to the manufacture of seasonal and decorative lighting products containing lead; and to repeal section 1376-b of the public health law relating thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1376-b of the public health law, as amended by a chapter of the laws of 2021 amending the public health law relating to the manufacture and sale of seasonal and decorative lighting products containing lead, as proposed in legislative bills numbers S. 5675-A and A. 4522-A, is REPEALED. § 2. The general business law is amended by adding a new article 25-C to read as follows: ARTICLE 25-C PRODUCTS CONTAINING LEAD SECTION 389-S. MANUFACTURE AND SALE OF SEASONAL AND DECORATIVE LIGHTING PRODUCTS CONTAINING LEAD. § 389-S. MANUFACTURE AND SALE OF SEASONAL AND DECORATIVE LIGHTING PRODUCTS CONTAINING LEAD. 1. WHEN USED IN THIS TITLE, "SEASONAL AND DECORATIVE LIGHTING PRODUCT" SHALL MEAN PORTABLE, PLUG-CONNECTED, TEMPO- RARY-USE LIGHTING PRODUCTS AND ACCESSORIES THAT HAVE A NOMINAL 120-VOLT INPUT VOLTAGE RATING. (A) LIGHTING PRODUCTS WITHIN THE SCOPE OF THIS RULE ARE FACTORY-ASSEM- BLED WITH PUSH-IN, MIDGET OR MINIATURE SCREW BASE LAMP HOLDERS CONNECTED IN SERIES OR PARALLEL, DIRECTLY ACROSS THE 120-VOLT INPUT. (B) SUCH LIGHTING PRODUCTS INCLUDE, BUT ARE NOT LIMITED TO LIGHTED DECORATIVE OUTFITS SUCH AS WIRED HOLIDAY STRING LIGHTS, PRE-LIT ARTIFI- CIAL CHRISTMAS TREES, PLANTS, FLOWERS OR WREATHS, STOCKINGS, STARS, CANDLES AND LIGHT SCULPTURES. 2. ON EACH SEASONAL AND DECORATIVE LIGHTING PRODUCT MANUFACTURED, SOLD OR DELIVERED BY A MANUFACTURER OR DISTRIBUTED WITHIN THIS STATE AFTER THE EFFECTIVE DATE OF THIS SECTION THAT CONTAINS AN ELECTRICAL CORD CASING IN WHICH LEAD IS PRESENT IN A QUANTITY GREATER THAN ONE HUNDRED EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
