BILL NUMBER: S8464 SPONSOR: KAPLAN TITLE OF BILL: An act to amend the public officers law, in relation to correcting gendered language PURPOSE: This legislation will update outdated gendered language when referring to the Governor in the public officers law SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends the public officers law by updating the gender by adding "their" in reference to the Governor's power to declare a special election to fill a vacancy in elective offices. Section 2 sets the effective date.

KAPLAN -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the public officers law, in relation to correcting gendered language THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 5 of section 42 of the public officers law, as amended by chapter 528 of the laws of 1950, is amended to read as follows: 5. Whenever the authority to fill any vacancy is vested in a board and such board is unable to fill such vacancy in an elective office by reason of a tie vote, or such board neglects to fill such vacancy for any other reason, the governor may, in [his] THEIR discretion, make proclamation of a special election to fill the vacancy. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14246-03-2
