BILL NUMBER: S8665 SPONSOR: STEWART-COUSINS TITLE OF BILL: An act extending the time within which certain elected and appointed officers may take or file their oaths of office or official undertakings PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to uphold the will of the electorate despite ministerial defects in certain oaths of office and official undertakings requirements. SUMMARY OF PROVISIONS: Section one of the bill provides that any duly elected or appointed officer or officers within a city in New York State as of January 1, 2022 through March 31, 2022 who failed to take or file his or her respective oath of office or official undertaking within the statutorily prescribed period shall continue to serve in such capacity and for the duration of their term upon the taking and filing of their require oaths

STEWART-COUSINS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT extending the time within which certain elected and appointed officers may take or file their oaths of office or official under- takings THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any law, rule, or regulation to the contra- ry, any duly elected or appointed officer or officers within any city in the state of New York as of January 1, 2022 through March 31, 2022, who failed to take or file their oath of office or official undertaking within the statutory prescribed period shall be permitted to continue to serve in such capacity for the duration of their term upon the taking and filing of their required oath of office or official undertaking consistent with sections 10 and 11 of the public officers law within 30 days of the effective date of this act. Such elected and appointed offi- cers who take and file their oath of office or official undertaking shall be deemed to have been continuously serving in office as of Janu- ary 1, 2022 or the date prescribed by their election through March 31, 2022. § 2.
