BILL NUMBER: S9094 SPONSOR: LIU TITLE OF BILL: An act to amend the executive law, in relation to expanding the defi- nition of "educational institution" PURPOSE OF THE BILL: This bill will add for-profit educational institutions that operate pre-kindergarten, kindergarten, primary schools, and secondary schools, to the education provisions of the Human Rights Law, thus making the Human Rights Law applicable to all private nonsectarian educational institutions. SUMMARY OF PROVISIONS: Section 1 adds any for-profit entity that operates a pre-kindergarten, kindergarten, primary school, or secondary school to the definition of "education institution."

LIU -- (at request of the Division of Human Rights) -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Government Operations AN ACT to amend the executive law, in relation to expanding the defi- nition of "educational institution" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 39 of section 292 of the exec- utive law, as amended by chapter 654 of the laws of 2021, is amended to read as follows: (b) any for-profit entity that operates a PRE-KINDERGARTEN, KINDERGAR- TEN, PRIMARY SCHOOL, SECONDARY SCHOOL, college, university, licensed private career school or certified English as a second language school which holds itself out to the public to be non-sectarian and which is not exempt from taxation pursuant to the provisions of article four of the real property tax law; or § 2. This act shall take effect on the sixtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14245-01-2
