BILL NUMBER: S9120 SPONSOR: SEPULVEDA TITLE OF BILL: An act to authorize the city of New York to discontinue a portion of real property in the county of the Bronx as parkland and to grant ease- ments for improvements to the railroad right-of-way to bring Metro-North railroad service to four new stations in the Bronx and to Pennsylvania Station in the county of New York PURPOSE: This bill would authorize the City of New York to alienate certain parcels of land to enable the Metropolitan Transportation Authority (MTA) to make critical improvements related to Penn Station Access Project which would enable Metro-North passengers to travel directly into Penn Station. SUMMARY OF PROVISIONS: Section 1 would authorize the City of New York to discontinue select
parkland as detailed within section three of the bill, to further the implementation of the Penn Station Access Project. Section 2 requires that MTA provide appropriate consideration to the City of New York in exchange for the granted easements, and establishes the relevant processes; it being the intent that such consideration will be determined after granting of such easements by the City pursuant to the provisions of Section 1266(12-a) of the Public Authorities Law, as it may apply. Section 3 identifies the metes and bounds of those portions of parkland that are proposed to be discontinued as parkland. Section 4 authorizes the MTA, at its discretion, to, at the end of the project, make certain transfers of some or all easements to the National Railroad Passenger Corporation. Section 5 provides for compliance with federal law, to the extent appli- cable. Section 6 provides that the bill shall take effect immediately. JUSTIFICATION: The Penn Station Access- Project seeks to allow commuters and other train passengers in the Northern suburbs of the New York City Metropol- itan area and Connecticut to access the West side of Midtown Manhattan more easily for working, business meetings, shopping, entertainment, dining, and other purposes. Currently, such train passengers are limited to Grand Central Terminal, and can only reach the West side through some combination of walking, taxi, bus, or subway, each of which presents its own obstacles of time, cost, and inconvenience. By bringing Metro-North trains directly into Penn Station, The Metropolitan Transportation Authority will provide an efficient and convenient method for seamless integration of travel to destinations on the West side of Manhattan for passengers who would otherwise be restricted to traversing through Grand Central Terminal and engaging in supplemental travel by pedestrian, car, bus, or subway service. This project is intended to supplement The Metropolitan Transportation Authority's related plan to bring trains of the Long Island Rail Road directly into Grand Central Terminal commonly known as "East Side Access" that promises to allow commuters and other train passengers using the Long Island Rail Road to directly access the East side of Midtown, Manhattan for working, business meetings, shopping, enter- tainment, dining, and other purposes. Until now, Metro-North trains only terminated at Grand Central Terminal in Midtown Manhattan, and Long Island Rail Road trains only terminated at Penn Station in Midtown Manhattan (although some of these trains terminated at Atlantic Terminal in Brooklyn). The Penn Station Access Project addresses half of this situation by allowing Metro-North passengers direct access to the West side of Midtown Manhattan, and the East Side Access Project addresses the other half of this situation by allowing Long Island Rail Road passengers direct access to the East side of Midtown Manhattan. This integration is further bolstered by the fact that for the Penn Station Access Project, Metro-North trains will be allowed to use existing Amtrak rails along Amtrak's Northeast corridor to connect Metro-North's exis ting rail lines to Penn Station. Metro-North plans to install and construct four new station buildings along Amtrak's line to facilitate better service availability for projected Metro-North customers seeking quicker and easier access to the West side of Midtown Manhattan. Subject to the provisions of this act, but notwithstanding any provision of any state or local law to the contrary, the city of New York is hereby authorized to discontinue the use as parklands of the lands described in section three of this act and to grant easements to the metropolitan transportation authority to enable the metropolitan transportation authority and Metro-North commuter railroad company, an affiliate of the metropolitan transportation authority, to construct improvements and gain ingress and egress to and from railroad equipment, stations and right-of-way on such former parkland, and to construct below surface and surface utility infrastructure, in order to bring Metro-North commuter railroad company service to four new stations in the Bronx and to Pennsylvania Station in the county of New York. Such easements shall be granted upon such terms and conditions as the city of New York and the metropolitan transportation authority shall determine, including terms and conditions for the metropolitan transportation authority to ensure that the city of New York can comply with section five of this act. § 2. The metropolitan transportation authority, as consideration for being granted easements described in this act, shall pay to the city of New York the fair market value of the parklands being discontinued. BILL NUMBER: S9120A SPONSOR: SEPULVEDA TITLE OF BILL: An act to authorize the city of New York to discontinue a portion of real property in the county of the Bronx as parkland and to grant ease- ments for improvements to the railroad right-of-way to bring Metro-North railroad service to four new stations in the Bronx and to Pennsylvania Station in the county of New York PURPOSE: This bill would authorize the City of New York to alienate certain parcels of land to enable the Metropolitan Transportation Authority (MTA) to make critical improvements related to Penn Station Access Project which would enable Metro-North passengers to travel directly into Penn Station. SUMMARY OF PROVISIONS: Section 1 would authorize the City of New York to discontinue select
parkland as detailed within section three of the bill, to further the implementation of the Penn Station Access Project. Section 2 requires that MTA provide appropriate consideration to the City of New York in exchange for the granted easements, and establishes the relevant processes; it being the intent that such consideration will be determined after granting of such easements by the City pursuant to the provisions of Section 1266(12-a) of the Public Authorities Law, as it may apply. Section 3 identifies the metes and bounds of those portions of parkland that are proposed to be discontinued as parkland. Section 4 provides for compliance with federal law, to the extent appli- cable Section 5 authorizes the MTA, at its discretion, to, at the end of the project, make certain transfers of some or all easements to the National Railroad Passenger Corporation. Section 6 Provides that the MTA restore the surface of the lands described and restore them to park use. Section 7 provides that the bill shall take effect immediately. JUSTIFICATION: The Penn Station Access- Project seeks to allow commuters and other train passengers in the Northern suburbs of the New York City Metropol- itan area and Connecticut to access the West side of Midtown Manhattan more easily for working, business meetings, shopping, entertainment, dining, and other purposes. Currently, such train passengers are limited to Grand Central Terminal, and can only reach the West side through some combination of walking, taxi, bus, or subway, each of which presents its own obstacles of time, cost, and inconvenience. By bringing Metro-North trains directly into Penn Station, The Metropolitan Transportation Authority will provide an efficient and convenient method for seamless integration of travel to destinations on the West side of Manhattan for passengers who would otherwise be restricted to traversing through Grand Central Terminal and engaging in supplemental travel by pedestrian, car, bus, or subway service. This project is intended to supplement The Metropolitan Transportation Authority's related plan to bring trains of the Long Island Rail Road directly into Grand Central Terminal commonly known as "East Side Access" that promises to allow commuters and other train passengers using the Long Island Rail Road to directly access the East side of Midtown, Manhattan for working, business meetings, shopping, enter- tainment, dining, and other purposes. Until now, Metro-North trains only terminated at Grand Central Terminal in Midtown Manhattan, and Long Island Rail Road trains only terminated at Penn Station in Midtown Manhattan (although some of these trains terminated at Atlantic Terminal in Brooklyn). The Penn Station Access Project addresses half of this situation by allowing Metro-North passengers direct access to the West side of Midtown Manhattan, and the East Side Access Project addresses the other half of this situation by allowing Long Island Rail Road passengers direct access to the East side of Midtown Manhattan. This integration is further bolstered by the fact that for the Penn Station Access Project, Metro-North trains will be allowed to use existing Amtrak rails along Amtrak's Northeast corridor to connect Metro-North's existing rail lines to Penn Station. Metro-North plans to install and construct four new station buildings along Amtrak's line to facilitate better service availability for projected Metro-North customers seeking quicker and easier access to the West side of Midtown Manhattan. Subject to the provisions of this act, but notwithstanding any provision of law to the contrary, the city of New York is hereby authorized to discontinue the use as parklands of the lands described in section three of this act and to grant easements to the metropolitan transportation authority, upon such terms and conditions as the city shall determine, to enable the metropolitan transportation authority and Metro-North commuter railroad company, an affiliate of the metropolitan transportation authority, to construct improvements and gain ingress and egress to and from railroad equipment, stations and right-of-way on such former parkland, and to construct below surface and surface utility infrastructure, in order to bring Metro-North commuter railroad company service to four new stations in the Bronx and to Pennsylvania Station in the county of New York. § 2. The authorization provided in section one of this act shall be effective only upon the condition that the city of New York dedicates an amount equal to or greater than the fair market of the parklands being discontinued towards the acquisition of new parklands and/or capital improvements to existing parklands and recreational facilities within the borough of the Bronx. § 3. In the event that the city of New York received any funding, support or assistance from the federal government for the purchase, maintenance or improvement of the parklands set forth in section three of this act, the discontinuance and alienation of such parkland author- ized by the provisions of this act shall not occur until the city of New York has complied with any federal requirements pertaining to the alien- ation or conversion of such parklands, including satisfying the secre- tary of the interior that the alienation or conversion complies with all conditions which the secretary of the interior deems necessary to assure the substitution of other lands shall be equivalent in fair market value and usefulness to the lands being alienated or converted. § 5. After completion of improvements to the former parkland discon- tinued and alienated by the city of New York pursuant to this act, the metropolitan transportation authority may, in its discretion, assign or otherwise transfer some or all of the easements granted pursuant to this act to the National Railroad Passenger Corporation or the successor thereto, subject to retention of such rights and obligations of the metropolitan transportation authority on behalf of Metro-North commuter railroad company as the metropolitan transportation authority may deem appropriate. § 6. Upon the completion of construction, the metropolitan transporta- tion authority shall, in agreement with the city of New York and in consultation with the local community board, restore the surface of the lands described in section three of this act and such lands shall continue to be used for park purposes. § 7. This act shall take effect immediately.
