BILL NUMBER: S9384 SPONSOR: CLEARE TITLE OF BILL: An act to amend the executive law, in relation to including abortion providers and patients in the address confidentiality program PURPOSE: To allow abortion providers, employees of abortion providers, patients of abortion providers, and the immediate family members each of the three groups to enroll in the address confidentiality program SUMMARY OF PROVISIONS: Section 1 provides that abortion providers and patients of abortion providers, are eligible to enroll in the address confidentiality program run by the office of the secretary of state. Section 2 provides the definition of "Abortion providers or patients of abortion providers"

CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to including abortion providers and patients in the address confidentiality program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph of section 108 of the executive law, as amended by chapter 141 of the laws of 2019, is amended to read as follows: There is created in the office of the secretary of state a program to be known as the "address confidentiality program" to protect victims of domestic violence, victims of human trafficking, victims of a sexual offense [and], victims of stalking AND ABORTION PROVIDERS OR PATIENTS OF ABORTION PROVIDERS by authorizing the use of designated addresses for such victims and their minor children. The program shall be administered by the secretary of state. § 2. Subdivision 1 of section 108 of the executive law is amended by adding a new paragraph (l) to read as follows: (L) "ABORTION PROVIDERS OR PATIENTS OF ABORTION PROVIDERS" SHALL MEAN: (I) A LICENSED HEALTH CARE PRACTITIONER OR LICENSED MEDICAL PROFES- SIONAL WHO PERFORMS OR INDUCES AN ABORTION AS AUTHORIZED UNDER SECTION TWO THOUSAND FIVE HUNDRED NINETY-NINE-BB OF THE PUBLIC HEALTH LAW, INCLUDING ANY EMPLOYEE, VOLUNTEER OR CONTRACTOR OF SUCH HEALTH CARE PRACTITIONER OR MEDICAL PROFESSIONAL; (II) A PATIENT OF A LICENSED HEALTH CARE PRACTITIONER OR LICENSED MEDICAL PROFESSIONAL WHO HAS HAD AN ABORTION OR INTENDS TO HAVE AN ABORTION AS DESCRIBED IN SUBPARAGRAPH (I) OF THIS PARAGRAPH; AND (III) AN IMMEDIATE FAMILY MEMBER AS DEFINED IN SUBDIVISION EIGHT OF SECTION TWO HUNDRED THIRTY-EIGHT OF THE PUBLIC HEALTH LAW OR MEMBERS OF THE HOUSEHOLD OF A PERSON DESCRIBED IN SUBPARAGRAPH (I) OR (II) OF THIS PARAGRAPH. § 3. The opening paragraph of subparagraph (i) and subparagraph (iv) of paragraph (a) of subdivision 2 of section 108 of the executive law, the opening paragraph of subparagraph (i) as amended by section 2 of EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

SUMMARY OF PROVISIONS: Section 1 provides that reproductive health care services providers, employees, volunteers, patients, or immediate family members of repro- ductive health care services providers, are eligible to enroll in the address confidentiality program run by the NYS Department of State.

The secretary shall designate state, local or nonprofit agencies that provide counseling, referral, shelter or other specialized services to victims of domestic violence, victims of human trafficking, victims of a sexual offense [and], victims of stalking, AND REPRODUCTIVE HEALTH CARE SERVICES PROVIDERS, EMPLOYEES, VOLUNTEERS, PATIENTS, OR IMMEDIATE FAMILY MEMBERS OF REPRODUCTIVE HEALTH CARE SERVICES PROVIDERS to assist persons apply- ing to be program participants. Such persons providing assistance shall be trained by the secretary. Any assistance and counseling rendered by an officer of the secretary or his or her designees to applicants shall in no way be construed as legal advice.
