 Introduced  by  Sens.  HOYLMAN,  RAMOS, RIVERA -- read twice and ordered
   printed, and when printed to be committed to the Committee  on  Insur-

 AN  ACT  to  amend the insurance law, in relation to requiring insurance
   coverage for pre-exposure prophylaxis and post-exposure prophylaxis to
   prevent HIV infection
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subsection  (i)  of  section 3216 of the insurance law is
 amended by adding a new paragraph 36 to read as follows:
   (36) EVERY POLICY WHICH PROVIDES COVERAGE FOR PRESCRIPTION DRUGS SHALL
 INCLUDE COVERAGE FOR THE COST OF PRE-EXPOSURE PROPHYLAXIS (PREP) FOR THE
 PREVENTION  OF  HIV  AND  POST-EXPOSURE  PROPHYLAXIS  TO   PREVENT   HIV
 INFECTION.
   § 2. Subsection (l) of section 3221 of the insurance law is amended by
 adding a new paragraph 21 to read as follows:
   (21) EVERY POLICY WHICH PROVIDES COVERAGE FOR PRESCRIPTION DRUGS SHALL
 INCLUDE COVERAGE FOR THE COST OF PRE-EXPOSURE PROPHYLAXIS (PREP) FOR THE
 PREVENTION   OF   HIV  AND  POST-EXPOSURE  PROPHYLAXIS  TO  PREVENT  HIV
 INFECTION.
   § 3. Section 4303 of the insurance law is  amended  by  adding  a  new
 subsection (ss) to read as follows:
   (SS)  EVERY  CONTRACT  ISSUED  BY A HOSPITAL SERVICES CORPORATION OR A
 HEALTH SERVICES CORPORATION WHICH  PROVIDES  COVERAGE  FOR  PRESCRIPTION
 DRUGS  SHALL  INCLUDE  COVERAGE FOR THE COST OF PRE-EXPOSURE PROPHYLAXIS
 (PREP) FOR THE  PREVENTION  OF  HIV  AND  POST-EXPOSURE  PROPHYLAXIS  TO
 PREVENT HIV INFECTION.
   § 4. This act shall take effect immediately.
