TITLE OF BILL:

An act to amend the executive law, in relation to requiring electric
vehicle charging stations and electric vehicle capable parking spaces

 
PURPOSE OR GENERAL IDEA OF BILL:

Requires electric vehicle charging stations and electric vehicle capable
parking spaces in certain new or substantially rehabilitated buildings.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 of the bill amends section 378 of the executive law by adding
subdivision 17-a. Standards require that new construction and buildings
undergoing substantial rehabilitation with off-street parking have elec-
tric charging stations or appropriate wiring, panels, and installation
space to install charging stations in the future.

The provisions are as follows:

-One- to three-family homes with off-street parking must have one elec-
tric vehicle capable parking space.

-Multi-family homes with between two and ten parking spaces must have at
least 75% EV capable spaces, with at least 20% of spaces equipped with a
charging station.

-Multi-family homes with more than ten parking spaces must have 100% of
spaces be EV capable, with at least 40% of spaces equipped with a charg-
ing station.

-Commercial buildings with between two and ten parking spaces must have
100% of spaces be EV capable, with at least 20% of spaces equipped with
at least a Level 2 charging station.

-Commercial buildings with more than ten parking spaces must have 100%
of spaces be EV capable, with at least 40', of spaces equipped with at
least a Level 2 charging station.

-Commercial buildings may opt to substitute one Level 3 charging station
for five required Level 2 charging stations.

Section 2 is the effective date.

 
JUSTIFICATION:

The presence of electric vehicle (EV) charging stations and parking
spaces in a community is associated with greater use of EVs. However,
the rate of adoption of EV parking spaces has been slow, mirrored by the
slow adoption of EVs themselves. In 2021, New York State took steps to
address to slow adoption of EVs by mandating new vehicles in the state
be all-electric by 2035. For the adoption of this policy to be success-
ful, the installation of the hardware needed to support a large number
of EVs on the road should be a priority of the state.  Accordingly, this
bill seeks to align New York's construction and building code policy
with the goals of the state expressed in the Climate Leadership and
Community Protection Act as well as the 2021 EV sales mandate by mandat-
ing the installation of EV infrastructure in certain instances during
new construction or rehabilitation.

 AN ACT to amend the executive law, in  relation  to  requiring  electric
   vehicle charging stations and electric vehicle capable parking spaces
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 378 of the executive law is amended by adding a new
 subdivision 17-a to read as follows:
   17-A. A. FOR THE PURPOSES OF THIS SUBDIVISION:
   (I) "SUBSTANTIAL REHABILITATION" MEANS REQUIRED REPAIRS, REPLACEMENTS,
 AND IMPROVEMENTS INVOLVING THE REPLACEMENT OF TWO OR MORE MAJOR BUILDING
 COMPONENTS, OR COSTING IN EXCESS OF EITHER FIFTEEN PERCENT (EXCLUSIVE OF
 ANY SOFT COSTS) OF THE PROPERTY'S FAIR MARKET VALUE AFTER COMPLETION  OF
 REHABILITATION  OR  SIX  THOUSAND FIVE HUNDRED DOLLARS PER DWELLING UNIT
 ADJUSTED BY THE UNITED STATES DEPARTMENT OF HOUSING AND  URBAN  DEVELOP-
 MENT HIGH COST PERCENTAGE.
   (II)  "MAJOR  BUILDING COMPONENT" MEANS ROOF STRUCTURES, WALL OR FLOOR
 STRUCTURES, FOUNDATIONS, AND PLUMBING, CENTRAL HEATING  AND  AIR  CONDI-
 TIONING, OR ELECTRICAL SYSTEMS, THAT ARE SIGNIFICANT TO THE BUILDING AND
 ITS  USE,  WHICH  ARE  NORMALLY  EXPECTED TO LAST THE USEFUL LIFE OF THE
 BUILDING AND NOT MINOR OR COSMETIC.
   B. STANDARDS TO REQUIRE  NEW  CONSTRUCTION  AND  BUILDINGS  UNDERGOING
 SUBSTANTIAL  REHABILITATION  WHICH  INCLUDE DEDICATED OFF-STREET PARKING
 AREAS TO HAVE:
   (I) ELECTRIC VEHICLE CHARGING STATIONS AS DEFINED IN PARAGRAPH (B)  OF
 SUBDIVISION  ONE  OF  SECTION  THREE  HUNDRED THIRTY-NINE-LL OF THE REAL
 PROPERTY LAW; AND
   (II) ELECTRIC VEHICLE CAPABLE PARKING SPACES, WHICH HAVE THE APPROPRI-
 ATE WIRING, ELECTRIC PANELS, AND THE APPROPRIATE SPACE TO INSTALL APPRO-
 PRIATE ELECTRIC SERVICE FOR AN ELECTRIC VEHICLE CHARGING STATION.
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

   C. THE NUMBER OF SPACES REQUIRED BY PARAGRAPH B OF THIS SECTION  SHALL
 BE AS FOLLOWS:
   (I)  A  ONE, TWO OR THREE-FAMILY HOME EQUIPPED WITH A GARAGE, DRIVEWAY
 OR PARKING LOT SHALL HAVE AT LEAST ONE ELECTRIC VEHICLE CAPABLE  PARKING
 SPACE, EXCEPT THAT ONE, TWO OR THREE-FAMILY HOMES UNDERGOING SUBSTANTIAL
 REHABILITATION  THAT DOES NOT INVOLVE A GARAGE, DRIVEWAY, OR PARKING LOT
 SHALL BE EXEMPT FROM THE REQUIREMENTS OF THIS SUBDIVISION;
   (II) A HOME FOR MORE THAN THREE FAMILIES  WITH  BETWEEN  TWO  AND  TEN
 PARKING  SPACES  SHALL  HAVE  AT LEAST SEVENTY-FIVE PERCENT OF AVAILABLE
 PARKING SPACES BE ELECTRIC VEHICLE CAPABLE PARKING SPACES,  WHICH  SHALL
 INCLUDE  AT LEAST TWENTY PERCENT OF AVAILABLE PARKING SPACES AS ELECTRIC
 VEHICLE CHARGING STATIONS. IF THERE IS A DECIMAL IN THE  CALCULATION  OF
 THE  PERCENTAGE  OF PARKING SPACES, SUCH DECIMAL SHALL BE ROUNDED TO THE
 NEXT LARGEST WHOLE NUMBER;
   (III) A MULTI-UNIT RESIDENTIAL BUILDING WITH AT LEAST  ELEVEN  PARKING
 SPACES  SHALL  HAVE  ONE  HUNDRED PERCENT OF AVAILABLE PARKING SPACES BE
 ELECTRIC VEHICLE CAPABLE PARKING SPACES, WHICH SHALL  INCLUDE  AT  LEAST
 FORTY  PERCENT  OF AVAILABLE PARKING SPACES AS ELECTRIC VEHICLE CHARGING
 STATIONS. IF THERE IS A DECIMAL IN THE CALCULATION OF THE PERCENTAGE  OF
 PARKING  SPACES, SUCH DECIMAL SHALL BE ROUNDED TO THE NEXT LARGEST WHOLE
 NUMBER;
   (IV) A COMMERCIAL BUILDING WITH BETWEEN TWO  AND  TEN  PARKING  SPACES
 SHALL  HAVE  ONE HUNDRED PERCENT OF AVAILABLE PARKING SPACES BE ELECTRIC

 STATIONS WITH AT LEAST A 208-240 VOLT, 40 AMP CIRCUIT;

 HAVE ONE HUNDRED PERCENT OF AVAILABLE PARKING SPACES BE ELECTRIC VEHICLE
 CAPABLE  PARKING  SPACES,  WHICH SHALL INCLUDE AT LEAST FORTY PERCENT OF
 AVAILABLE PARKING SPACES AS ELECTRIC VEHICLE CHARGING STATIONS  WITH  AT

 FIVE REQUIRED ELECTRIC VEHICLE CHARGING STATIONS OF LOWER VOLTAGE.
   §  2.  This  act  shall take effect on the sixtieth day after it shall
 have become a law.

JUSTIFICATION:

The presence of electric vehicle (EV) charging stations and parking
spaces in a community is associated with greater use of EVs. However,
the rate of adoption of EV parking spaces has been slow, mirrored by the
slow adoption of EVs themselves. In 2021, New York State took steps to
address to slow adoption of EVs by mandating new vehicles in the state
be all-electric by 2035. For the adoption of this policy to be success-
ful, the installation of the hardware needed to support a large number
of EVs on the road should be a priority of the state.  Accordingly, this
bill seeks to align New York's construction and building code policy
with the goals of the state expressed in the Climate Leadership and
Community Protection Act as well as the 2021 EV sales mandate by mandat-
ing the installation of EV infrastructure in certain instances during
new construction or rehabilitation.

 AN  ACT  to  amend  the executive law, in relation to requiring electric
   vehicle charging stations and electric vehicle capable parking spaces
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 378 of the executive law is amended by adding a new
 subdivision 17-a to read as follows:
   17-A. A. STANDARDS TO REQUIRE NEW CONSTRUCTION THAT INCLUDES DEDICATED
 OFF-STREET  PARKING  INVOLVING  A GARAGE, DRIVEWAY, PARKING LOT OR OTHER
 OFF-STREET PARKING, TO HAVE:
   (I) ELECTRIC VEHICLE CHARGING STATIONS AS DEFINED IN PARAGRAPH (B)  OF
 SUBDIVISION  ONE  OF  SECTION  THREE  HUNDRED THIRTY-NINE-LL OF THE REAL
 PROPERTY LAW; AND
   (II) ELECTRIC VEHICLE CAPABLE PARKING SPACES, WHICH HAVE THE APPROPRI-
 ATE WIRING, ELECTRIC PANELS, AND THE APPROPRIATE SPACE TO INSTALL APPRO-
 PRIATE ELECTRIC SERVICE FOR AN ELECTRIC VEHICLE CHARGING STATION.
   B. SUCH STANDARDS SHALL REQUIRE THAT THE NUMBER  OF  ELECTRIC  VEHICLE
 CAPABLE  PARKING  SPACES PURSUANT TO SUBPARAGRAPH (II) OF PARAGRAPH A OF
 THIS SUBDIVISION BE AS FOLLOWS:

   (VI) A PRIVATELY-OWNED COMMERCIAL BUILDING SUBJECT TO THE REQUIREMENTS
 OF SUBPARAGRAPH (IV) OR (V) OF THIS PARAGRAPH, THE INSTALLATION  OF  ONE
 400-900  VOLT  DIRECT  CURRENT FAST CHARGING STATION SHALL BE CONSIDERED
 EQUIVALENT TO FIVE REQUIRED ELECTRIC VEHICLE CHARGING STATIONS OF  LOWER
 VOLTAGE.
   C.  FOR  THE PURPOSES OF THIS SUBDIVISION, "PRIVATELY-OWNED COMMERCIAL
 BUILDING" SHALL MEAN ANY NEWLY  CONSTRUCTED  COMMERCIAL  BUILDING  UNDER
 PRIVATE  CONTRACT  WHICH HAS NOT RECEIVED STATE CAPITAL FUNDING FOR SUCH
 CONSTRUCTION.
   § 2. This act shall take effect April  1,  2023  and  shall  apply  to
 contracts for new construction entered into on and after such date.

TITLE OF BILL:

An act to amend the executive law, in relation to requiring electric
vehicle charging stations and electric vehicle capable parking spaces

 
PURPOSE OR GENERAL IDEA OF BILL:

Requires electric vehicle charging stations and electric vehicle capable
parking spaces in certain new buildings.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 of the bill amends section 378 of the executive law by adding
subdivision 17-a. Standards require that new construction with dedicated
off-street parking involving a garage, driveway, parking lot or other
off-street parking have electric vehicle charging stations or appropri-
ate wiring, panels, and installation space to install charging stations
in the future.

The provisions are as follows:

- One- to three-family homes with off-street parking must have one elec-
tric vehicle capable parking space.

- Multi-family homes with between two and ten parking spaces must have
at least 75% EV capable spaces, with at least 20% of spaces equipped
with a charging station.

- Multi-family homes with more than ten parking spaces must have 100% of
spaces be EV capable, with at least 40% of spaces equipped with a charg-
ing station.

- Privately-owned commercial buildings with between two and ten parking
spaces must have 100% of spaces be EV capable, with at least 20% of
spaces equipped with at least a Level 2 charging station.

- Privately-owned commercial buildings with more than ten parking spaces
must have 100% of spaces be EV capable, with at least 40% of spaces
equipped with at least a Level 2 charging station.

- Commercial buildings may opt to substitute one Level 3 charging
station for five required Level 2 charging stations.

- Building owners may apply for a waiver if they can demonstrate that
the provisions present an undue hardship due to limitations of the local
utility provider, or that the geographic location of the site is such
that compliance would result in a significant burden on the owner.

Section 2 establishes an effective date of April 1, 2023.

 WAIVER OF THE REQUIREMENTS OF THIS SUBDIVISION, WHICH SUCH LOCAL DEPART-
 MENT  OF  BUILDINGS OR SIMILAR ENTITY MAY GRANT IF SUCH OWNER CAN DEMON-
 STRATE THAT THE PROVISIONS PRESENT AN UNDUE HARDSHIP DUE TO  LIMITATIONS
 OF  THE  LOCAL  UTILITY PROVIDER, OR THAT THE GEOGRAPHIC LOCATION OF THE
 SITE IS SUCH THAT COMPLIANCE WOULD RESULT IN A SIGNIFICANT BURDEN ON THE
 OWNER.
   § 2. This act shall take effect April  1,  2023  and  shall  apply  to
 contracts for new construction entered into on and after such date.
