EPSTEIN -- read once and referred to the Commit- tee on Governmental Operations AN ACT to amend the state finance law, in relation to participation by individuals with disabilities with respect to state employment and state contracts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 163 of the state finance law is amended by adding a new subdivision 16 to read as follows: 16. A. CONTRACTORS SHALL REPORT TO STATE AGENCIES REGARDING THE UTILI- ZATION AND PARTICIPATION OF WORK ON BOTH SERVICE AND COMMODITY CONTRACTS BY A PERSON WITH A DISABILITY AS DEFINED IN SUBDIVISION TWENTY-ONE OF SECTION TWO HUNDRED NINETY-TWO OF THE EXECUTIVE LAW. NOTHING IN THIS SUBDIVISION SHALL BE DEEMED TO REQUIRE A DISCLOSURE OF STATUS OF AN INDIVIDUAL WITH A DISABILITY, WHERE NOT OTHERWISE REQUIRED, HOWEVER, NOTHING SHALL PREVENT AN INDIVIDUAL FROM VOLUNTARILY SELF-REPORTING AS AN INDIVIDUAL WITH A DISABILITY. B. STATE AGENCIES SHALL COMPILE SUCH INFORMATION AND REPORT ANNUALLY TO THE OFFICE OF GENERAL SERVICES. THE OFFICE OF GENERAL SERVICES SHALL SUBMIT A REPORT ANNUALLY TO THE STATE PROCUREMENT COUNCIL, THE GOVERNOR, THE STATE COMPTROLLER, THE TEMPORARY PRESIDENT OF THE SENATE AND SPEAKER OF THE ASSEMBLY DETAILING THE PERCENTAGE OF WORK BEING DONE BY INDIVID- UALS WITH A DISABILITY ON SERVICE AND COMMODITY CONTRACTS. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law; provided, however that the amendments to section 163 of the state finance law made by section one of this act shall not affect the repeal of such section and shall be deemed repealed therewith. Effective immediately, the addition, amendment and/ or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date. SUCH REPORT SHALL INCLUDE AGGREGATE DATA ON THE EMPLOYMENT OF INDIVIDUALS WITH DISABILITIES, THEIR LEVEL OF PARTICIPATION ON SUCH STATE CONTRACTS, AND ANY POLICIES AND PRACTICES CARRIED OUT BY STATE CONTRACTORS AND SUBCONTRACTORS TO PROMOTE EMPLOYMENT OF INDIVIDUALS WITH DISABILITIES WITHIN THEIR WORKFORCE.
