S T A T E O F N E W Y O R K ________________________________________________________________________ 5821 2023-2024 Regular Sessions I N A S S E M B L Y March 23, 2023 ___________ Introduced by M. of A. LAVINE -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to the minimum age for lifeguards THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 225 of the public health law is amended by adding a new subdivision 5-d to read as follows: 5-D. THE STATE SANITARY CODE SHALL: (A) REQUIRE ALL SWIMMING POOLS, BATHING BEACHES, AND CHILDREN'S CAMPS TO EMPLOY QUALIFIED LIFEGUARDS THAT MEET THE FOLLOWING QUALIFICATIONS: (I) BE AT LEAST SEVENTEEN YEARS OF AGE, EXCEPT: (A) A MAXIMUM OF FIFTY PERCENT OF THE REQUIRED TOTAL NUMBER OF LIFE- GUARDS ON DUTY MAY BE AT LEAST FIFTEEN YEARS OF AGE PROVIDED THEY ARE UNDER THE DIRECT SUPERVISION OF AN AQUATIC SUPERVISORY STAFF, SUPERVISO- RY LIFEGUARD, OR CAMP AQUATICS DIRECTOR AS REQUIRED BY PARTS SIX AND SEVEN OF THE STATE SANITARY CODE; AND (B) LIFEGUARDS REQUIRED FOR WILDERNESS SWIMMING MUST BE AT LEAST EIGH- TEEN YEARS OF AGE; AND (II) MEET LIFEGUARDING, FIRST AID AND CPR CERTIFICATION REQUIREMENTS AS REQUIRED IN PARTS SIX AND SEVEN OF THE STATE SANITARY CODE; AND (B) REQUIRE ALL QUALIFIED LIFEGUARDS WHILE ON DUTY AT THE WATERFRONT TO NOT BE ENGAGED IN DUTIES OR ACTIVITIES WHICH DISTRACT THEM FROM THE DIRECT SUPERVISION OF THE WATERFRONT. § 2. This act shall take effect on the ninetieth day it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date.
