TAPIA, DINOWITZ -- read once and referred to the Committee on Governmental Operations AN ACT to amend the executive law, in relation to establishing a program to provide reduced cost or no cost lithium-ion batteries used in powered mobility devices THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The executive law is amended by adding a new section 156-i to read as follows: § 156-I. LITHIUM-ION BATTERY SAFETY PROGRAM. 1. FOR PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: A. "LITHIUM-ION BATTERY" MEANS A STORAGE BATTERY IN WHICH AN ELEC- TRICAL CURRENT IS GENERATED BY LITHIUM IONS EMBEDDED IN A CARBON GRAPHITE OR NICKEL METAL-OXIDE SUBSTRATE PLACED IN A HIGH-VISCOSITY CARBONATE MIXTURE OR GELLED POLYMER ELECTROLYTE; AND B. "POWERED MOBILITY DEVICE" MEANS A LIGHT ELECTRIC-POWERED VEHICLE OR PERSONAL ELECTRIC MOBILITY DEVICE SUCH AS AN ELECTRIC BICYCLE OR SCOOT- ER. 2. THE OFFICE OF FIRE PREVENTION AND CONTROL, IN COLLABORATION WITH THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION AND ANY OTHER APPROPRIATE AGENCY, SHALL ESTABLISH A PROGRAM TO PROVIDE NEW LITHIUM-ION BATTERIES AT REDUCED COST OR NO COST TO ELIGIBLE INDIVIDUALS, WHICH MAY INCLUDE PROVISION OF NEW LITHIUM-ION BATTERIES IN EXCHANGE FOR USED LITHIUM-ION BATTERIES. THE OFFICE OF FIRE PREVENTION AND CONTROL SHALL DETERMINE WHICH INDIVIDUALS ARE ELIGIBLE TO PARTICIPATE IN SUCH PROGRAM, THE CRITERIA FOR PROVISION AND EXCHANGE OF LITHIUM-ION BATTERIES, AND THE AMOUNT OF COST REDUCTION FOR THE LITHIUM-ION BATTERIES PROVIDED. ALL NEW BATTERIES PROVIDED PURSUANT TO SUCH PROGRAM SHALL BE LISTED AND LABELED BY A NATIONALLY RECOGNIZED TESTING LABORATORY. § 2. Section 1854 of the public authorities law is amended by adding a new subdivision 27 to read as follows: 27. LITHIUM-ION BATTERY SAFETY PROGRAM. (B) NO LATER THAN ONE YEAR AFTER THE EFFECTIVE DATE OF THIS SUBDIVI- SION, THE AUTHORITY, IN COLLABORATION WITH THE DEPARTMENT OF ENVIRON- MENTAL CONSERVATION AND ANY OTHER APPROPRIATE AGENCY, SHALL DEVELOP AND ADMINISTER A PROGRAM TO PROVIDE REBATES OR NEW LITHIUM-ION BATTERIES FOR POWERED MOBILITY DEVICES AT REDUCED COST OR NO COST TO ELIGIBLE INDIVID- UALS.
