 AN  ACT to amend the public health law, in relation to the dispensing of
   drug adulterant testing supplies
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Paragraph  (a)  of subdivision 1 of section 3309-b of the
 public health law, as added by chapter 654  of  the  laws  of  2023,  is
 amended to read as follows:
   (a)  "Drug adulterant testing supplies" means any drug testing product
 that is used to determine whether a controlled substance contains fenta-
 nyl [or], a fentanyl analog, OR XYLAZINE.
   § 2.  This act shall take effect on the thirtieth day after  it  shall
 have become a law; provided, however, that if chapter 654 of the laws of
 2023  shall  not have taken effect on or before such date, then this act
 shall take effect on the same date and in the same manner as chapter 654
 of the laws of 2023, takes effect. Effective immediately, the  addition,
 amendment  and/or  repeal  of  any  rule or regulation necessary for the
 implementation of this act on its effective date are  authorized  to  be
 made and completed on or before such effective date.

 AN  ACT to amend the public health law, in relation to the dispensing of
   drug adulterant testing supplies
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Paragraph  (a)  of subdivision 1 of section 3309-b of the
 public health law, as amended by chapter 16 of  the  laws  of  2024,  is
 amended to read as follows:
   (a)  "Drug adulterant testing supplies" means any drug testing product
 that is used to determine whether a substance  contains  fentanyl  or  a
 fentanyl analog, XYLAZINE, OR OTHER SUBSTANCE.
   §  2.   This act shall take effect on the thirtieth day after it shall
 have become a law.    Effective  immediately,  the  addition,  amendment
 and/or repeal of any rule or regulation necessary for the implementation
 of  this  act  on  its  effective  date  are  authorized  to be made and
 completed on or before such effective date.
