BILL NUMBER: S1353 SPONSOR: BRISPORT TITLE OF BILL: An act to amend the social services law, in relation to exempting certain income and resources provided to persons enrolled in certain pilot programs with direct cash transfers in determining eligibility for public assistance benefits PURPOSE: This is a chapter amendment that makes changes to provisions L.2022 c.749, to clarify provisions regarding federal waiver requests and fix technical issues. SUMMARY OF PROVISIONS: This legislation amends the underlying chapter by making the federal waiver request to the US Department of Agriculture a permissive require- ment as opposed to mandatory.

BRISPORT -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the social services law, in relation to exempting certain income and resources provided to persons enrolled in certain pilot programs with direct cash transfers in determining eligibility for public assistance benefits THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (x) of paragraph (a) of subdivision 8 of section 131-a of the social services law, as added by a chapter of the laws of 2022 amending the social services law relating to exempting certain income and resources provided to persons enrolled in certain pilot programs with direct cash transfers in determining eligibility for public assistance benefits, as proposed in legislative bills numbers S. 5759-B and A. 6709-B, is amended to read as follows. [(x)] (XI) Any financial assistance received by individuals as part of their participation in a pilot program that has developed a plan to study and evaluate the impact and potential benefits of direct cash transfers. Such exemption and disregard shall be applicable for the length of time the individual participates in the program, but not long- er than sixty months. [The commissioner shall seek federal waiver authority to disregard income for the direct cash transfer pilot program for the purpose of the supplemental nutrition assistance program.] § 2. Section 36-a of the social services law is amended by adding a new subdivision 4 to read as follows: 4. THE COMMISSIONER SHALL SEEK ANY FEDERAL WAIVER OR WAIVERS FROM THE UNITED STATES DEPARTMENT OF AGRICULTURE THAT MAY BE NECESSARY TO EXCLUDE INCOME PROVIDED TO AN INDIVIDUAL AS PART OF THEIR PARTICIPATION IN A PILOT PROGRAM AUTHORIZED UNDER SECTION ONE HUNDRED THIRTY-ONE-A OF THIS CHAPTER FOR SUPPLEMENTAL NUTRITION ASSISTANCE PROGRAM ELIGIBILITY DETER- MINATION PURPOSES.
