BILL NUMBER: S1983 SPONSOR: GOUNARDES TITLE OF BILL: An act to amend the education law, in relation to high school diploma requirements PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to create a new requirement for high school graduation under the Education Law; requiring a student to either complete and submit the Free Application for Federal Student Aid (FAFSA), or complete a waiver stating the student understands what the FAFSA is and has chosen not to file an application. This bill also creates a requirement for high schools to notify students at least four times a year about state-sponsored scholarships, financial aid, and other available assistance. GOUNARDES -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to high school diploma requirements THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 305 of the education law is amended by adding a new subdivision 60 to read as follows: 60. A. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, THE COMMISSIONER SHALL PROMULGATE RULES AND REGULATIONS TO REQUIRE AS A CONDITION OF AWARDING A HIGH SCHOOL DIPLOMA TO A STUDENT, THE PARENT OR GUARDIAN OF SUCH STUDENT OR, IF THE STUDENT IS EIGHTEEN YEARS OF AGE OR OLDER OR LEGALLY EMANCIPATED, SUCH STUDENT, TO COMPLY WITH ONE OF THE FOLLOWING: (I) COMPLETE AND SUBMIT THE FREE APPLICATION FOR FEDERAL STUDENT AID (FAFSA) FOR SUCH STUDENT; OR (II) COMPLETE A WAIVER FORM, CREATED BY THE DEPARTMENT, TO BE FILED WITH THE STUDENT'S SCHOOL DISTRICT INDICATING THAT THE PARENT OR GUARDI- AN OR, IF THE STUDENT IS EIGHTEEN YEARS OF AGE OR OLDER OR LEGALLY EMAN- CIPATED, THE STUDENT, UNDERSTANDS WHAT THE FAFSA IS AND HAS CHOSEN NOT TO FILE AN APPLICATION PURSUANT TO THE PROVISIONS OF SUBPARAGRAPH (I) OF THIS PARAGRAPH. B. EACH SCHOOL DISTRICT SHALL BE REQUIRED TO REPORT TO THE COMMISSION- ER, ON THE FIRST OF JULY OF EACH YEAR: (I) THE TOTAL NUMBER OF COMPLETED FAFSAS PURSUANT TO SUBPARAGRAPH (I) OF PARAGRAPH A OF THIS SUBDIVISION FOR THE PRIOR ACADEMIC YEAR; (II) THE TOTAL NUMBER OF COMPLETED WAIVER FORMS PURSUANT TO SUBPARA- GRAPH (II) OF PARAGRAPH A OF THIS SUBDIVISION FOR THE PRIOR ACADEMIC YEAR; (III) THE TOTAL NUMBER OF SENIOR YEAR STUDENTS IN THE PRIOR ACADEMIC YEAR; AND EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. BILL NUMBER: S1983AREVISED 6/1/23 SPONSOR: GOUNARDES TITLE OF BILL: An act to amend the education law, in relation to notice of post-secon- dary financial aid programs PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to require all schools to present on post- secondary financial aid opportunities such as the Free Application for Federal Student Aid (FAFSA) or a DREAM Act application and for students to complete an affidavit indicating if they will be applying for such aid. SUMMARY OF PROVISIONS: Section 1 of the bill adds a new Part VI to Article 14 of the Education Law to require the Higher Education Services Corporation (HESC) to create a uniform presentation on FAFSA and DREAM, which will be presented to all students throughout the state.

THE CORPORATION SHALL CREATE A UNIFORM PRESENTATION ON THE AVAILABILITY OF POST-SECONDARY FINANCIAL AID PROGRAMS, INCLUDING TRAINING ON THE FREE APPLICATION FOR FEDERAL STUDENT AID (FAFSA) AND APPLICATION FOR AID AVAILABLE TO INDIVIDUALS MEETING THE REQUIREMENTS OF SUBPARAGRAPH (II) OF PARAGRAPH (A) OF SUBDIVISION FIVE OF SECTION SIX HUNDRED SIXTY-ONE OF THIS ARTICLE. THE CORPORATION, IN CONJUNCTION WITH THE DEPARTMENT, SHALL DISTRIBUTE THE PRESENTATION MATE- RIALS TO ALL SCHOOLS THROUGHOUT THE STATE WHICH EDUCATE STUDENTS THROUGH TWELFTH GRADE. EACH SCHOOL SHALL BE REQUIRED TO USE SUCH MATERIALS WHEN COMPLYING WITH THE PROVISIONS OF THIS PART AND SHALL NOT BE PERMITTED TO CREATE THEIR OWN VERSIONS OF SUCH PRESENTATION MATERIALS. § 694-D. FINANCIAL AID PRESENTATION. 1.
