BILL NUMBER: S2379 SPONSOR: PERSAUD TITLE OF BILL: An act to amend the transportation law, in relation to requiring certain for-hire vehicles to install and maintain an interior rear-facing video camera PURPOSE OR GENERAL IDEA OF BILL: This legislation requires certain for-hire vehicles to install and main- tain an interior rear-facing video camera to bring up-to-date current law while also adapting to new technology. It would also allow for the use of front facing cameras as long as the minimum requirements are met. Lastly, this would allow for local law enforcement and local regulatory authority to gain access to the everyday operation recorded on the camera in the for-hire vehicle. PERSAUD -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the transportation law, in relation to requiring certain for-hire vehicles to install and maintain an interior rear-facing video camera THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 140 of the transportation law is amended by adding a new subdivision 11 to read as follows: 11. A. ALL COMMERCIAL MOTOR VEHICLES THAT TRANSPORT PASSENGERS FOR- HIRE WITH A SEATING CAPACITY OF SIX PASSENGERS OR LESS EXCEPT FOR A BLACK CAR, LIMOUSINE, OR LUXURY LIMOUSINE, AS SUCH TERMS ARE DEFINED IN SECTION 19-502 OF THE ADMINISTRATIVE CODE OF THE CITY OF NEW YORK, OR AS OTHERWISE DEFINED IN LOCAL LAW, SHALL BE REQUIRED TO INSTALL AND MAIN- TAIN AN INTERIOR REAR-FACING VIDEO CAMERA. SUCH VIDEO CAMERA SHALL BE RECORDING AT ALL TIMES THE VEHICLE IS BEING OPERATED FOR THE PURPOSE OF FOR-HIRE TRANSPORTATION, AND AT MINIMUM SHALL: (I) CAPTURE AND RECORD ANY OPERATOR OR PASSENGER WHO ENTERS OR EXITS THE VEHICLE; (II) STORE, AT A MINIMUM, THE SIXTY MOST RECENT HOURS OF OPERATION; AND (III) HAVE THE ABILITY TO TRANSMIT DATA OR OTHERWISE PROVIDE ACCESS TO LOCAL LAW ENFORCEMENT AND THE LOCAL REGULATORY AUTHORITY WHICH HAS LICENSED THE MOTOR VEHICLE FOR FOR-HIRE TRANSPORTATION SERVICES. B. THE REQUIREMENT SET FORTH IN THIS SUBDIVISION SHALL NOT LIMIT THE BRAND OR PROVIDER OF VIDEO CAMERAS WHICH CAN BE UTILIZED TO COMPLY WITH THIS SUBDIVISION. RATHER, ANY COMMERCIAL VIDEO CAMERA THAT MEETS THE MINIMUM REQUIREMENTS OF THIS SUBDIVISION SHALL BE CONSIDERED AS COMPLY- ING WITH THIS SUBDIVISION. C. NO LAW OR REGULATION SHALL PROHIBIT THE INSTALLATION AND USE OF A FRONT-FACING CAMERA AS LONG AS THE MINIMUM REQUIREMENTS SET FORTH IN EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. It would also allow for the use of front facing cameras as long as the minimum requirements are met. THIS REQUIREMENT SHALL NOT LIMIT THE BRAND OR PROVIDER OF VIDEO CAMERAS WHICH CAN BE UTILIZED TO COMPLY WITH THIS PARAGRAPH. PROVIDED FURTHER THAT THE INSTALLATION AND USE OF A FRONT-FACING CAMERA IS PERMITTED AS LONG AS THE MINIMUM REQUIREMENTS SET FORTH BELOW ARE MET, AND SO LONG AS THE FOR-HIRE VEHI- CLE OWNER'S MOTOR VEHICLE INSURANCE PROVIDER HAS ACCESS TO THE DATA RECORDED BY SUCH CAMERA UNLESS SPECIFICALLY EXEMPTED BY LAW. SUCH VIDEO CAMERA SHALL BE RECORDING AT ALL TIMES THE VEHICLE IS PROVIDING TRANS- PORTATION FOR HIRE, AND AT MINIMUM SHALL: 1. CAPTURE AND RECORD ANY OPERATOR OR PASSENGER WHO ENTERS OR EXITS THE VEHICLE; 2. STORE, AT A MINIMUM, THE SIXTY MOST RECENT HOURS OF OPERATION; AND 3.
