BILL NUMBER: S242 SPONSOR: MAY TITLE OF BILL: An act to amend the election law, in relation to establishing portable polling locations for early voting PURPOSE: Section 1: amends the election law to allow counties the option to establish two or more locations for portable polling places for early voting, which must be operative for no fewer than three consecutive days and that will not replace or otherwise decrease the mandated number of regular early voting polling places. MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT to amend the election law, in relation to establishing portable polling locations for early voting THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 8-600 of the election law is amended by adding a new subdivision 2-a to read as follows: 2-A. (A) IN ADDITION TO THE DESIGNATION OF POLLING PLACES REQUIRED BY SUBDIVISION TWO OF THIS SECTION, A COUNTY BOARD OF ELECTIONS MAY ESTAB- LISH ONE OR MORE PORTABLE POLLING LOCATIONS FOR PURPOSES OF EARLY VOTING, PROVIDED THAT THE MAXIMUM NUMBER OF LOCATIONS A COUNTY MAY ESTABLISH FOR SUCH PORTABLE POLLING LOCATIONS SHALL BE DETERMINED BY THE STATE BOARD OF ELECTIONS BASED ON POPULATION. THE DESIGNATION AND LOCATION OF ANY PORTABLE POLLING PLACE SHALL BE MADE NO LATER THAN FOUR- TEEN DAYS BEFORE AN ELECTION. (B) LOCATIONS FOR PORTABLE POLLING LOCATIONS FOR EARLY VOTING SHALL BE SELECTED TO PROVIDE THE MAXIMUM NUMBER OF VOTERS IN A COUNTY WITH ADEQUATE ACCESS TO EARLY VOTING, TAKING INTO CONSIDERATION POPULATION DENSITY, TRAVEL TIME TO THE POLLING PLACE, PROXIMITY TO OTHER EARLY VOTING POLL SITES, PUBLIC TRANSPORTATION ROUTES, COMMUTER TRAFFIC PATTERNS AND SUCH OTHER FACTORS THE BOARD OF ELECTIONS DEEMS APPROPRI- ATE. SUCH LOCATION OR LOCATIONS SHALL BE INCLUDED AS PART OF THE COMMU- NICATION PLAN DEVELOPED BY EACH BOARD OF ELECTIONS PURSUANT TO SUBDIVI- SION FIVE OF THIS SECTION. (C) LOCATIONS FOR PORTABLE POLLING LOCATIONS FOR EARLY VOTING SHALL BE OPERATIONAL FOR NO FEWER THAN THREE CONSECUTIVE DAYS. (D) NO PORTABLE POLLING LOCATION FOR EARLY VOTING ESTABLISHED BY THIS SUBDIVISION SHALL REPLACE OR OTHERWISE DECREASE THE NUMBER OF POLLING PLACES FOR EARLY VOTING REQUIRED BY SUBDIVISION TWO OF THIS SECTION.
