TITLE OF BILL:

An act to amend the public health law, in relation to the maternal
health crisis; and to repeal title 3 of article 25 of such law relating
to the control of midwifery

 
PURPOSE:

To establish a plan to address the severe maternal morbidity crisis in
parts of the state.

 
SUMMARY OF PROVISIONS:

Section 1 provides the title of the act as the "Chisholm Chance Act".

Section 2 amends title 3 3 of article 25 of the public health law by
repealing it and adding a new title 3 which provides the legislative
findings, and directs the Department of Health to develop, establish and
administer a community led and operated administrative HUB in Kings

County and Bronx County to contract with multiple payers to coordinate
outreach by specially trained community-based organizations and communi-
ty health workers to find and engage the highest need women and children
in those counties.

It also directs the Department of health to establish the infrastructure
of the HUB, an advisory board and governance structure for the HUB, hire
and train community health workers and doulas, establish a single point
of entry for addressing social determinants of health, synchronize
systems across networks of community-based organizations with health-
care, behavioral and social service delivery systems, and achieve
certification from the Pathways Community HUB institute within six
months of the beginning of operations.

Section 3 provided the effective date.

 
JUSTIFICATION:

In New York, severe maternal morbidity constitutes a maternal health
crisis that poses a serious threat to the health and quality of life of
many women and children. New York is among the bottom third of states
for the number of pregnancy-related deaths, with women of color dying at
a rate three and one-half times more than other women. The highest rates
of severe maternal morbidity occurs in two counties, Kings and the
Bronx, with the highest rate occurring in north and central Brooklyn.
This is a disgrace that requires the establishment of a plan to address
the severe maternal morbidity crisis.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. This act shall be known and may be cited as  the  "Chisholm
 Chance Act".
   §  2. Title 3 of article 25 of the public health law is REPEALED and a
 new title 3 is added to read as follows:
                                 TITLE III
                            CHISHOLM CHANCE ACT
 SECTION 2560. LEGISLATIVE FINDINGS.
         2561. ADMINISTRATIVE HUB.
   § 2560. LEGISLATIVE FINDINGS. 1.  THE  LEGISLATURE  HEREBY  FINDS  AND
 DECLARES  THAT  SEVERE  MATERNAL MORBIDITY CONSTITUTES A MATERNAL HEALTH
 CRISIS THAT POSES A SERIOUS THREAT TO THE HEALTH AND QUALITY OF LIFE  OF
 MANY  WOMEN  AND  CHILDREN. NEW YORK IS AMONG THE BOTTOM THIRD OF STATES
 FOR THE NUMBER OF WOMEN DYING, WITH WOMEN OF COLOR DYING AT A RATE THREE
 AND ONE-HALF TIMES MORE THAN OTHER WOMEN. THE HIGHEST  RATES  OF  SEVERE
 MATERNAL  MORBIDITY OCCURS IN TWO COUNTIES, KINGS AND BRONX COUNTY, WITH
 THE HIGHEST RATE OCCURRING IN NORTH AND CENTRAL BROOKLYN.
   2. THE LEGISLATURE FURTHER FINDS AND DECLARES THAT A  PLAN  SHOULD  BE
 ESTABLISHED TO ADDRESS THE SEVERE MATERNAL MORBIDITY CRISIS.
   § 2561. ADMINISTRATIVE HUB. 1. THE DEPARTMENT SHALL DEVELOP, ESTABLISH
 AND  ADMINISTER A COMMUNITY LED AND OPERATED ADMINISTRATIVE HUB IN KINGS
 COUNTY AND BRONX COUNTY TO CONTRACT WITH MULTIPLE  PAYERS  IN  ORDER  TO
 COORDINATE  OUTREACH  BY SPECIALLY TRAINED COMMUNITY-BASED ORGANIZATIONS
 AND COMMUNITY HEALTH WORKERS TO FIND AND ENGAGE THE HIGHEST  NEED  WOMEN

 AND  CHILDREN  IN  KINGS  COUNTY  AND BRONX COUNTY. THE DEPARTMENT SHALL
 ALSO:
   (A) ESTABLISH THE ADMINISTRATIVE HUB'S INFRASTRUCTURE;
   (B)  ESTABLISH  AN  ADVISORY  BOARD  AND  GOVERNANCE STRUCTURE FOR THE
 ADMINISTRATIVE HUB;
   (C) HIRE AND TRAIN COMMUNITY HEALTH WORKERS AND DOULAS, UP TO ONE  PER
 COMMUNITY-BASED ORGANIZATION;
   (D)  ESTABLISH  A SINGLE POINT OF ENTRY FOR ADDRESSING SOCIAL DETERMI-
 NANTS OF HEALTH;
   (E) SYNCHRONIZE SYSTEMS ACROSS NETWORKS OF  COMMUNITY-BASED  ORGANIZA-
 TIONS  WITH  HEALTHCARE, BEHAVIORAL AND SOCIAL SERVICE DELIVERY SYSTEMS;
 AND
   (F) ACHIEVE CERTIFICATION FROM THE PATHWAYS  COMMUNITY  HUB  INSTITUTE
 WITHIN SIX MONTHS OF THE BEGINNING OF OPERATIONS.
   2.  COMMUNITY  HEALTH  WORKERS  SHALL  BE  CONTRACTED  TO IDENTIFY AND
 ADDRESS STANDARDIZED HEALTH RISKS VIA  SHARED  METRICS  OR  STANDARDIZED
 PATHWAYS  THAT HAVE DEMONSTRATED AN IMPACT ON THE SOCIAL DETERMINANTS OF
 HEALTH.
   3. THE ADMINISTRATIVE HUB SHALL  COORDINATE  PARTICIPATING  COMMUNITY-
 BASED  ORGANIZATIONS AND COMMUNITY HEALTH WORKERS TO ADDRESS GAPS IN THE
 SYSTEMS OF CARE FOR THE HIGHEST NEED WOMEN AND CHILDREN IN KINGS  COUNTY
 AND BRONX COUNTY.
   4.  THE  ADMINISTRATIVE HUB SHALL BEGIN OPERATIONS BEFORE THE FIRST OF
 JANUARY NEXT SUCCEEDING THE EFFECTIVE DATE OF THIS TITLE.
   § 3. This act shall take effect immediately.

 THE HIGHEST RATE OCCURRING IN NORTH AND CENTRAL BROOKLYN.
   2. THE LEGISLATURE FURTHER FINDS AND DECLARES THAT CENTERS OF MATERNAL
 AND  CHILDCARE SERVICES SHOULD BE ESTABLISHED AT THE STATE UNIVERSITY OF
 NEW YORK DOWNSTATE MEDICAL CENTER IN  KINGS  COUNTY  AND  AT  MONTEFIORE
 MEDICAL  CENTER IN BRONX COUNTY TO ADDRESS THE SEVERE MATERNAL MORBIDITY
 CRISIS.
   § 2561.  STATE UNIVERSITY OF NEW YORK CENTER OF MATERNAL AND CHILDCARE
 SERVICES.  1. THERE IS HEREBY ESTABLISHED WITHIN THE STATE UNIVERSITY OF
 NEW YORK DOWNSTATE MEDICAL CENTER A CENTER  OF  MATERNAL  AND  CHILDCARE
 SERVICES,  HEREINAFTER  REFERRED TO IN THIS SECTION AS "THE CENTER". THE
 CENTER SHALL BE DEDICATED TO THE CARE OF WOMEN AND  CHILDREN  AND  SHALL
 OFFER  SERVICES,  INCLUDING  BUT  NOT LIMITED TO: (A) PRENATAL CARE; (B)
 PRENATAL AND CHILDBIRTH CLASSES; (C) LABOR AND DELIVERY CARE;  (D)  HIGH
 RISK PREGNANCY CARE; (E) INPATIENT AND OUTPATIENT LACTATION CONSULTATION
 AND  SUPPORT;  (F) HEART HEALTH AND HEART DISEASE PREVENTION; (G) BREAST
 HEALTH AND MAMMOGRAPHY; (H) GYNECOLOGIC SURGERY; (I)  IMAGING;  (J)  LAB
 SERVICES; AND (K)POSTPARTUM CARE.
   2. THE CENTER SHALL PROVIDE CLINICAL EXPERIENCES FOR STUDENTS ENROLLED
 IN  THE  STATE UNIVERSITY OF NEW YORK DOWNSTATE HEALTH SCIENCES CENTER'S
 SCHOOL OF HEALTH PROFESSIONS MIDWIFERY PROGRAM.
   3. THE CENTER SHALL ALSO COLLABORATE WITH THE STATE UNIVERSITY OF  NEW
 YORK  DOWNSTATE HEALTH SCIENCES CENTER FOR THE CONDUCTION OF RESEARCH TO
 INFORM AND SUPPORT HEALTH  CARE  PROFESSIONALS  PROVIDING  MATERNAL  AND
 CHILDCARE  SERVICES  AT THE CENTER. SUCH RESEARCH SHALL PRIORITIZE WOMEN
 AND CHILDREN OF COLOR AND SHALL INCLUDE, BUT  NOT  BE  LIMITED  TO:  (A)
 RESEARCH  TO BETTER UNDERSTAND AND ADDRESS THE INCREASING RATES OF LIFE-
 THREATENING COMPLICATIONS AROUND PREGNANCY; (B)  IDENTIFYING  BIOMARKERS
 FOR  RISK  OF  MORBIDITY  AND  MORTALITY DURING AND AFTER PREGNANCY; (C)
 RACIAL AND ETHNIC DISPARITIES IN RATES OF PREGNANCY-RELATED  DEATH;  AND
 (D)  TREATMENTS  THAT  WILL REDUCE THE RATES OF LIFE-THREATENING COMPLI-
 CATIONS DURING PREGNANCY, LABOR AND DELIVERY, AND THE POSTPARTUM PERIOD.
   4. THE CENTER SHALL COORDINATE WITH LOCAL SOCIAL SERVICES AGENCIES AND
 SPECIALLY TRAINED COMMUNITY-BASED ORGANIZATIONS TO IDENTIFY AND  ADDRESS
 GAPS  IN  SYSTEMS  OF  CARE  AND COORDINATE OUTREACH EFFORTS TO FIND AND
 ENGAGE HIGH-NEED WOMEN AND CHILDREN IN KINGS COUNTY.
   § 2562. MONTEFIORE MEDICAL CENTER OF MATERNAL AND CHILDCARE  SERVICES.
 1.  THERE  IS  HEREBY ESTABLISHED WITHIN THE MONTEFIORE MEDICAL CENTER A
 CENTER OF MATERNAL AND CHILDCARE SERVICES, HEREINAFTER  REFERRED  TO  IN
 THIS  SECTION AS "THE CENTER". THE CENTER SHALL BE DEDICATED TO THE CARE
 OF WOMEN AND CHILDREN AND SHALL OFFER SERVICES, INCLUDING BUT NOT LIMIT-
 ED TO: (A) PRENATAL CARE; (B) PRENATAL AND CHILDBIRTH CLASSES; (C) LABOR
 AND DELIVERY CARE; (D) HIGH  RISK  PREGNANCY  CARE;  (E)  INPATIENT  AND
 OUTPATIENT  LACTATION  CONSULTATION  AND  SUPPORT;  (F) HEART HEALTH AND
 HEART DISEASE PREVENTION; (G) BREAST HEALTH AND MAMMOGRAPHY; (H) GYNECO-
 LOGIC SURGERY; (I) IMAGING; (J) LAB SERVICES; AND (K) POSTPARTUM CARE.
   2. THE CENTER SHALL PROVIDE CLINICAL EXPERIENCES FOR STUDENTS ENROLLED
 IN HOSTOS COMMUNITY COLLEGE.
   3. THE CENTER SHALL ALSO COLLABORATE WITH HOSTOS COMMUNITY COLLEGE FOR
 THE CONDUCTION OF RESEARCH TO INFORM AND  SUPPORT  HEALTH  CARE  PROFES-
 SIONALS  PROVIDING  MATERNAL AND CHILDCARE SERVICES AT THE CENTER.  SUCH
 RESEARCH SHALL PRIORITIZE WOMEN AND CHILDREN OF COLOR AND SHALL INCLUDE,
 BUT NOT BE LIMITED TO: (A) RESEARCH TO BETTER UNDERSTAND AND ADDRESS THE
 INCREASING RATES OF LIFE-THREATENING COMPLICATIONS AROUND PREGNANCY; (B)
 IDENTIFYING BIOMARKERS FOR RISK OF MORBIDITY AND  MORTALITY  DURING  AND
 AFTER  PREGNANCY; (C) RACIAL AND ETHNIC DISPARITIES IN RATES OF PREGNAN-

 CY-RELATED DEATH; AND (D) TREATMENTS THAT WILL REDUCE THE RATES OF LIFE-
 THREATENING COMPLICATIONS DURING PREGNANCY, LABOR AND DELIVERY, AND  THE

   4. THE CENTER SHALL COORDINATE WITH LOCAL SOCIAL SERVICES AGENCIES AND

   §  2563. APPROPRIATIONS. THE PROVISIONS OF THIS TITLE SHALL BE SUBJECT
 TO AVAILABLE STATE APPROPRIATIONS.
   § 3. This act shall take effect immediately.
