BILL NUMBER: S3459 SPONSOR: SKOUFIS TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to allowing brewery supply stores to sell New York state labelled beer for off premises consumption PURPOSE OR GENERAL IDEA OF BILL: To broaden the number of opportunities brewery supply stores have to promote their businesses by authorizing the sale of craft beer for off- premises consumption, thereby aiding such businesses in promoting the sale of their brewery supply products. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Section 3 of the alcoholic beverage control law is amended by adding a new subdivision 4-a to provide a definition for what consti- tutes a "Brewery Supply Store," meaning any place or premises where ingredients and equipment to make beer, wine and cider in the home are

SKOUFIS -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the alcoholic beverage control law, in relation to allowing brewery supply stores to sell New York state labelled beer for off premises consumption THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3 of the alcoholic beverage control law is amended by adding a new subdivision 4-a to read as follows: 4-A. (A) "BREWERY SUPPLY STORE" MEANS AND INCLUDES ANY PLACE OR PREM- ISES WHERE INGREDIENTS AND EQUIPMENT TO MAKE BEER, WINE AND CIDER IN THE HOME ARE SOLD. A BREWERY SUPPLY STORE MAY BE ON THE SAME PREMISES AS A BREWERY. (B) A BREWERY SUPPLY STORE LICENSED TO SELL BEER FOR OFF-PREMISES CONSUMPTION UNDER SUBDIVISION FOUR OF SECTION FIFTY-FOUR OF THIS CHAPTER SHALL SELL ONLY NEW YORK STATE LABELLED BEER AS DEFINED IN SUBDIVISION TWENTY-D OF THIS SECTION. § 2. Subdivision 4 of section 54 of the alcoholic beverage control law, as amended by chapter 503 of the laws of 1954, is amended to read as follows: 4. No such license shall be issued, however, to any person for any premises other than a grocery store, drug store, BREWERY SUPPLY STORE, or duly licensed supply ship operating in harbors in Lake Erie. § 3. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD06657-01-3
