BILL NUMBER: S4175 SPONSOR: KENNEDY TITLE OF BILL: An act to amend the executive law, in relation to including extreme winter weather preparedness in local comprehensive emergency management plans PURPOSE OR GENERAL IDEA OF BILL: This bill would amend the definition of a "disaster" to include extreme winter weather and would require that local comprehensive emergency management plans include plans for extreme winter weather, including evacuation plans and sheltering-in-place plans, along with how to deal with transit networks, utilities, and community warming centers. Addi- tionally it provides for an annual inventory of the municipality's extreme winter weather equipment, including the age and condition of such equipment. SUMMARY OF SPECIFIC PROVISIONS:

KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Securi- ty and Military Affairs AN ACT to amend the executive law, in relation to including extreme winter weather preparedness in local comprehensive emergency manage- ment plans THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph a of subdivision 2 of section 20 of the executive law, as amended by chapter 23 of the laws of 2020, is amended to read as follows: a. "disaster" means occurrence or imminent, impending or urgent threat of wide spread or severe damage, injury, or loss of life or property resulting from any natural or man-made causes, including, but not limit- ed to, fire, flood, earthquake, hurricane, EXTREME WINTER WEATHER, tornado, high water, landslide, mudslide, wind, storm, wave action, volcanic activity, epidemic, disease outbreak, air contamination, terrorism, cyber event, blight, drought, infestation, explosion, radio- logical accident, nuclear, chemical, biological, or bacteriological release, water contamination, bridge failure or bridge collapse. § 2. Section 23 of the executive law is amended by adding a new subdi- vision 8 to read as follows: 8. SUCH PLANS SHALL ADDITIONALLY INCLUDE, BUT NOT BE LIMITED TO, THE FOLLOWING REGARDING EXTREME WINTER WEATHER: A. EVACUATION PLANS AND SHELTERING-IN-PLACE PLANS IN THE CASE OF EXTREME WINTER WEATHER, SUCH PLANS SHOULD INCLUDE HOW TO DEAL WITH TRAN- SIT NETWORKS, UTILITIES, AND COMMUNITY WARMING CENTERS; AND B. AN ANNUAL INVENTORY OF THE MUNICIPALITY'S EXTREME WINTER WEATHER EQUIPMENT, SUCH INVENTORY SHALL INCLUDE THE AGE AND CONDITION OF SUCH EQUIPMENT. § 3. This act shall take effect immediately.
