TITLE OF BILL:

An act to amend the parks, recreation and historic preservation law, in
relation to allowing the presence of dogs in state parks

 
PURPOSE:

The purpose of this legislation is to permit the presence of dogs in all
state parks with the exception of the Adirondack park and Catskill park.

 
SUMMARY OF PROVISIONS:

Section 1. The parks, recreation and historic preservation law is
amended by adding a new section 3.27 that authorizes the admittance of
dogs into state parks and grants the parks commissioner authority to
adopt any rules, regulations and programs deemed necessary for dog
access provided such rules and programs do not conflict with the
provisions of this bill. This section further provides clarity on when
and where dogs are permitted in state parks, the responsibilities and

liabilities of the owner or custodian of the dog, and the requirement of
state parks to provide dog care stations.

Section 2. Is the enacting clause

 
JUSTIFICATION:

New York State Parks are sacred areas of land where residents and visi-
tors can commune, exercise, and appreciate the beautiful landscapes
available to us. While many people would love to share this experience
with their dog (s), some parks do not currently permit them. Park visi-
tors should have the option to bring their dog/s with them to enjoy open
green space, trails and the solace of nature state parks provide. This
bill affords state parks with the flexibility to restrict certain areas
from being accessible to dogs, which may include protected bird nesting
sites. This measure encourages coexistence between park visitors, dogs,
wildlife and the environment.

 
FISCAL IMPLICATIONS:

To be determined.

 
EFFECTIVE DATE:
This act shall take effect on the one hundred twentieth day after it
shall have become a law.

 AN ACT to amend the parks, recreation and historic preservation law,  in
   relation to allowing the presence of dogs in state parks

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The parks, recreation  and  historic  preservation  law  is
 amended by adding a new section 3.27 to read as follows:
   §  3.27  DOGS  ALLOWED  IN  PARKS. 1. THE COMMISSIONER SHALL ADOPT ANY
 RULES, REGULATIONS AND PROGRAMS NECESSARY FOR THE PRESENCE AND  BEHAVIOR
 OF  DOGS  IN  STATE  PARKS, PROVIDED THAT SUCH RULES AND PROGRAMS DO NOT
 CONFLICT WITH THE PROVISIONS OF THIS SECTION.
   2. FOR THE PURPOSES OF THIS SECTION, THE FOLLOWING  TERMS  SHALL  HAVE
 THE FOLLOWING MEANINGS:
   (A)  "STATE  PARK"  SHALL  MEAN  ANY  PUBLIC PARK, RECREATION AREA, OR
 NATURAL AREA THAT IS OWNED AND OPERATED BY THE STATE OF  NEW  YORK  WITH
 THE EXCEPTION OF THE ADIRONDACK PARK AND THE CATSKILL PARK.
   (B)  "DOG"  SHALL  MEAN ANY DOMESTIC ANIMAL OF THE SPECIES CANIS FAMI-
 LIARIS.
   3. (A) DOGS SHALL BE ALLOWED IN ALL NEW  YORK  STATE  PARKS  WITH  THE
 EXCEPTION  OF  THE  ADIRONDACK  PARK AND THE CATSKILL PARK DURING PUBLIC
 HOURS OF OPERATION YEAR-ROUND, INCLUDING, BUT NOT LIMITED TO, TRAILS AND
 BEACHES EXCEPT AS PROVIDED IN SUBDIVISION FOUR OF THIS SECTION.
   (B) ALL STATE PARKS SHALL INSTALL AND OFFER DOG CARE STATIONS, INCLUD-
 ING, BUT NOT LIMITED TO, GARBAGE CANS AND DISPOSABLE BIODEGRADABLE WASTE
 BAGS TO ENSURE A CLEAN AND HYGIENIC ENVIRONMENT FOR ALL PARK VISITORS.
   (C) ALL DOGS SHALL BE UNDER DIRECT  SUPERVISION  AND  CONTROL  AT  ALL
 TIMES BY THE OWNER OR CUSTODIAN OF THE DOG.
   (D)  DOGS SHALL BE LEASHED AT ALL TIMES UNLESS A STATE PARK DESIGNATES
 A SPECIFIC UNLEASHED AREA.

   (E) WASTE SHALL BE REMOVED AND DISPOSED OF BY THE DOG OWNER.
   (F)  DOG  OWNERS OR CUSTODIANS ASSUME LIABILITY FOR ANY DAMAGE OR HARM
 CAUSED BY THEIR DOG ON PARK PREMISES.
   (G) DOGS ARE NOT PERMITTED WITHIN AT LEAST ONE  HUNDRED  FEET  OF  ANY
 AREAS RESTRICTED FOR PROTECTION OF ENDANGERED SPECIES AND/OR NESTING.
   4.  (A)  DOGS  SHALL  NOT  BE ALLOWED IN AREAS OF STATE PARKS THAT ARE
 DESIGNATED BY PARKS AS "RESTRICTED".
   (B) DOGS SHALL NOT BE ALLOWED IN STATE PARKS DURING EVENTS  OR  ACTIV-
 ITIES THAT ARE SPECIFICALLY DESIGNATED AS "DOG-FREE".
   (C) DOGS SHALL NOT BE ALLOWED IN STATE PARKS IF THEY ARE NOT UNDER THE
 CONTROL  OF THEIR OWNER OR CUSTODIAN, OR IF THEY POSE A THREAT TO PUBLIC
 SAFETY.
   (D) DOGS THAT HAVE NOT BEEN FULLY  VACCINATED  PURSUANT  TO  ANY  LAW,
 RULES  OR  REGULATIONS  REQUIRING  SUCH VACCINES SHALL NOT BE ALLOWED IN
 STATE PARKS.
   5. (A) THE OFFICE SHALL HAVE THE AUTHORITY TO ENFORCE  THE  PROVISIONS
 OF THIS SECTION, INCLUDING, BUT NOT LIMITED TO, THE POWER TO ISSUE CITA-
 TIONS AND FINES FOR VIOLATIONS.
   (B)  THE  OFFICE SHALL ALSO HAVE THE AUTHORITY TO EXCLUDE SUCH OWNER'S
 DOG OR DOGS FROM STATE PARKS FOR A PERIOD OF TIME IF THE OWNER OR CUSTO-
 DIAN OF THE DOG FAILS TO COMPLY WITH THE PROVISIONS OF THIS  SECTION  OR
 THE RULES, REGULATIONS AND PROGRAMS ADOPTED BY THE STATE PARK SYSTEM.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law.

 ING THE PRESENCE OF DOGS IN AREAS DESIGNATED FOR SWIMMING OR  SUNBATHING
 ON BEACHES AND RESIDENT WILDLIFE IN PRESERVES.
   (C)  ALL  STATE  PARKS  SHALL  INSTALL  AND  OFFER DOG WASTE STATIONS,
 INCLUDING, BUT NOT LIMITED TO, GARBAGE CANS AND DISPOSABLE BIODEGRADABLE
 WASTE BAGS TO ENSURE A CLEAN AND HYGIENIC ENVIRONMENT FOR ALL PARK VISI-
 TORS.
   (D) ALL DOGS SHALL BE UNDER DIRECT  SUPERVISION  AND  CONTROL  AT  ALL
 TIMES BY THE OWNER OR CUSTODIAN OF THE DOG.

 JURISDICTION  OF  THE OFFICE DURING PUBLIC HOURS OF OPERATION YEAR-ROUND
 EXCEPT AS PROVIDED IN SUBDIVISION THREE OF THIS SECTION.
   (B) ALL STATE PARKS WHERE DOGS ARE PERMITTED SHALL INSTALL  AND  OFFER
 DOG  WASTE  STATIONS, INCLUDING, BUT NOT LIMITED TO, DISPOSABLE RECEPTA-
 CLES AND DISPOSABLE BIODEGRADABLE WASTE  BAGS  TO  ENSURE  A  CLEAN  AND
 HYGIENIC ENVIRONMENT FOR ALL PARK VISITORS.
   (C)  ALL  DOGS  SHALL  BE  UNDER DIRECT SUPERVISION AND CONTROL AT ALL
 TIMES BY THE OWNER OR CUSTODIAN OF THE DOG.
   (D) DOGS SHALL BE LEASHED AT ALL TIMES UNLESS A STATE PARK  DESIGNATES
 A SPECIFIC UNLEASHED AREA.
   (E)  WASTE  SHALL  BE PROPERLY REMOVED AND DISPOSED OF BY THE OWNER OR
 CUSTODIAN OF THE DOG.

   (F) DOG OWNERS AND CUSTODIANS SHALL BE LIABLE FOR ANY DAMAGE  OR  HARM
 CAUSED  BY  THEIR  DOG ON PARK PREMISES AND SUBJECT TO PENALTIES FOR ANY
 VIOLATION OF THIS SECTION.
   3.  IN ADDITION TO OTHER RELEVANT MATTERS, THE RULES, REGULATIONS, AND
 PROGRAMS REQUIRED BY SUBDIVISION ONE OF THIS SECTION SHALL:
   (A) LIMIT THE PRESENCE OF DOGS IN THE MANNER AND TO  THE  EXTENT  THAT
 THE  COMMISSIONER  DEEMS  APPROPRIATE,  INCLUDING  BUT  NOT  LIMITED  TO
 RESTRICTING THE PRESENCE OF DOGS:
   (I) AT CERTAIN TIMES OF DAY OR CERTAIN TIMES OF YEAR; AND
   (II) FOR THE PROTECTION OF WILDLIFE, OTHER ASPECTS OF THE ENVIRONMENT,
 THE QUALITY OF THE PARK, AND THE EXPERIENCE OF OTHER PARK USERS;
   (B) INCLUDE SPECIFIC PROHIBITIONS PROVIDING THAT  DOGS  SHALL  NOT  BE
 ALLOWED IN STATE PARKS:
   (I)  DURING  EVENTS  OR ACTIVITIES THAT ARE SPECIFICALLY DESIGNATED AS
 "DOG-FREE";
   (II) IF THEY ARE DEEMED A "DANGEROUS  DOG"  PURSUANT  TO  SECTION  ONE
 HUNDRED EIGHT OF THE AGRICULTURE AND MARKETS LAW;
   (III)  WITHOUT  BEING FULLY VACCINATED PURSUANT TO ALL LAWS, RULES AND
 REGULATIONS REQUIRING SUCH VACCINES;
   (IV) WITHIN ONE HUNDRED FEET OF ANY AREAS RESTRICTED FOR PROTECTION OF
 RARE, THREATENED, OR ENDANGERED SPECIES AND/OR NESTING,  OR  WITHIN  ANY
 ARBORETUM;
   (V) IN BUILDINGS;
   (VI) IN AREAS DESIGNATED FOR SWIMMING;
   (VII) IN SUNBATHING AREAS ON BEACHES;
   (VIII) ON GOLF COURSES;
   (IX) ON PLAYGROUNDS AND SPRAYGROUNDS; AND
   (X) AT SUCH OTHER TIMES, PLACES, AND IN SUCH MANNER AS THE COMMISSION-
 ER MAY DEEM APPROPRIATE; AND
   (C) SET PENALTIES FOR VIOLATIONS OF THIS SECTION.
   4.  (A)  THE OFFICE SHALL HAVE THE AUTHORITY TO ENFORCE THE PROVISIONS
 OF THIS SECTION, INCLUDING, BUT NOT LIMITED TO, THE POWER TO ISSUE CITA-
 TIONS AND FINES FOR VIOLATIONS.
   (B) THE OFFICE SHALL ALSO HAVE THE AUTHORITY TO EXCLUDE  SUCH  OWNER'S
 DOG OR DOGS FROM STATE PARKS FOR A PERIOD OF TIME IF THE OWNER OR CUSTO-
 DIAN  OF  THE DOG FAILS TO COMPLY WITH THE PROVISIONS OF THIS SECTION OR
 THE RULES, REGULATIONS AND PROGRAMS ADOPTED BY THE STATE PARK SYSTEM.
   § 2. This act shall take effect on the one hundred twentieth day after
 it shall have become a law.
