BILL NUMBER: S5798 SPONSOR: FERNANDEZ TITLE OF BILL: An act to amend the civil rights law, in relation to the right to breast feed PURPOSE OR GENERAL IDEA OF BILL: To change the verbiage from "mother" to "person" in regards to the right to breastfeed. SUMMARY OF PROVISIONS: Section 1 amends the civil rights law by changing the term "mother" to "person" and using gender neutral pronouns. Section 2 sets the effective date. JUSTIFICATION:

S T A T E O F N E W Y O R K ________________________________________________________________________ 5798 2023-2024 Regular Sessions I N S E N A T E March 16, 2023 ___________ Introduced by Sen. FERNANDEZ -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the civil rights law, in relation to the right to breast feed THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 79-e of the civil rights law, as added by chapter 98 of the laws of 1994, is amended to read as follows: § 79-e. Right to breast feed. Notwithstanding any other provision of law, a [mother] PERSON may breast feed [her] THEIR baby in any location, public or private, where the [mother] PERSON is otherwise authorized to be, irrespective of whether or not the nipple of the [mother's] PERSON'S breast is covered during or incidental to the breast feeding. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10233-01-3
