BILL NUMBER: S5830 SPONSOR: SALAZAR TITLE OF BILL: An act to amend the correction law, in relation to amending the defi- nition of special populations to include persons who are in the first eight weeks of the post-partum recovery period regardless of pregnancy outcome PURPOSE OR GENERAL IDEA OF BILL: The purpose of this legislation is to make clear that the limits on segregated confinement in correctional facilities are applicable in the first eight weeks of a woman's post-partum recovery period, regardless of how the pregnancy ended. SUMMARY OF PROVISIONS: Section 1: amends Correction Law § 2(33) to add that its definition of "special populations" extends to all persons in the first eight weeks of their postpartum recovery period, regardless of how their pregnancies

SALAZAR -- read twice and ordered printed, and when printed to be committed to the Committee on Crime Victims, Crime and Correction AN ACT to amend the correction law, in relation to amending the defi- nition of special populations to include persons who are in the first eight weeks of the post-partum recovery period regardless of pregnancy outcome THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 33 of section 2 of the correction law, as added by chapter 93 of the laws of 2021, is amended to read as follows: 33. "Special populations" means any person: (a) twenty-one years of age or younger; (b) fifty-five years of age or older; (c) with a disa- bility as defined in paragraph (a) of subdivision twenty-one of section two hundred ninety-two of the executive law; or (d) who is pregnant, in the first eight weeks of the post-partum recovery period [after giving birth] REGARDLESS OF HOW THE PREGNANCY ENDED, or caring for a child in a correctional institution pursuant to subdivisions two or three of section six hundred eleven of this chapter. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD10329-02-3
