BILL NUMBER: S6110 SPONSOR: BORRELLO TITLE OF BILL: An act relating to waiving the local residency requirement for public employees in the village of Portville PURPOSE: Waives the local residency requirement for public employees in the village of Portville. SUMMARY OF PROVISIONS: Section 1: The village of Portville, county of Cattaraugus, adopted a resolution providing the waiving of the local residency requirement for public employees to not only include the county of Cattaraugus but to include all counties of New York State. Notwithstanding any other provision of law to the contrary, the village of Portville, county of Cattaraugus as a condition of employment, shall permit public employees to reside within any county in the state of New York.

BORRELLO -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT relating to waiving the local residency requirement for public employees in the village of Portville THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The village of Portville, county of Cattaraugus, adopted a resolution providing for the waiving of the local residency requirement for public employees to include not only the county of Cattaraugus, but to include all counties in the state of New York. Notwithstanding any other provision of law to the contrary, the village of Portville, county of Cattaraugus shall not require public employees to reside in the coun- ty of Cattaraugus as a condition of employment, and shall permit public employees to reside within any county in the state of New York. § 2. PROVIDED, HOWEVER, THAT ANY PERSON PERFORMING SUCH FUNCTIONS OR HOLDING SUCH OFFICES IN ANY OTHER COUNTY SHALL BE A RESIDENT OF SUCH COUNTY UNLESS OTHERWISE PROVIDED BY LAW. § 2.
