BILL NUMBER: S7212 SPONSOR: KRUEGER TITLE OF BILL: An act to amend the military law and the New York state urban develop- ment corporation act, in relation to authorizing the use of the seventh regiment armory by a not-for-profit entity PURPOSE: This bill would provide the Knickerbocker Greys permanent space at and use of the Seventh Regiment Armory. SUMMARY OF PROVISIONS: Section 1 amends section 180-a of the Military Law to provide the Knick- erbocker Greys permanent access to the Armory, a permanent headquarters at the Armory, and permanent meeting and event space at the Seventh Regiment Armory. KRUEGER, SERRANO -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Home- land Security and Military Affairs AN ACT to amend the military law and the New York state urban develop- ment corporation act, in relation to authorizing the use of the seventh regiment armory by a not-for-profit entity THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 180-a of the military law is amended by adding a new paragraph (l) to read as follows: (L) "KNICKERBOCKER GREYS PROGRAM USE" SHALL MEAN USE DURING PERIODS WHICH ARE NOT PERIODS OF CIVIL OR MILITARY EMERGENCY, THE KNICKERBOCKER GREYS SHALL HAVE THE RIGHT TO ACCESS AND USE, FOR A PERMANENT HEADQUAR- TERS, SUFFICIENT AND SUITABLE SPACE, CONSISTING OF NO LESS THAN TWELVE HUNDRED SQUARE FEET, FOR THE CURRENT AND UNINTERRUPTED DAILY OPERATION OF PROGRAMMING, AS WELL AS USUAL AND CUSTOMARY BUILDING SERVICES AND UTILITIES, INCLUDING BUT NOT LIMITED TO HEAT, WATER AND ELECTRIC. § 2. Paragraph (e) of subdivision 3 of section 180-a of the military law, as added by chapter 482 of the laws of 2004, is amended to read as follows: (e) The management agreement and lease shall not apply to shelter use OR TO KNICKERBOCKER GREYS PROGRAM USE. Shelter use shall be governed by a separate agreement between the city of New York, the lessee and the state of New York; such separate agreement shall be executed prior to the execution of the lease. KNICKERBOCKER GREYS PROGRAM USE SHALL BE GOVERNED BY A SEPARATE AGREEMENT BETWEEN THE DIVISION AND THE STATE OF NEW YORK; SUCH SEPARATE AGREEMENT SHALL BE EXECUTED NO LATER THAN SEPTEMBER FIFTEENTH, TWO THOUSAND TWENTY-THREE. § 3. Subparagraph (i) of paragraph (c) of subdivision 3 of section 180-a of the military law, as added by chapter 482 of the laws of 2004, is amended to read as follows: EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. SUMMARY OF PROVISIONS: Section 1 amends section 180-a of the Military Law to define a legacy cadet corps program which consists of a cadet corps program or militia program that has used the same regimental armory within the city of New York as its headquarters for over one hundred years.
