TITLE OF BILL:

An act to amend the education law, in relation to enacting the "New York
city Caribbean steel pan educational music program act"

 
PURPOSE:

To enact the "New York City Caribbean Steel Pan Educational Music
Program" Act and allow student in NYC to learn how to play the Steel
Drum as well as provide a safe space for Steel bands to rehearse for
summer performances.

 
SUMMARY OF PROVISIONS:

Section 1. Short Title

Section 2. Paragraph (c) of subdivision 1 of section 414 of the educa-
tion law, as amended by chapter 345 of the laws of 2009, is amended.

Section 3. Subdivision 27 of section 2590-h of the education law, as
amended by chapter 345 of the laws of 2009, is amended

Section 4. Section 2590-h of the education law is amended by adding a
new subdivision 57

Section 5. This act shall take effect on the ninetieth day after it
shall have become a law; provided, however, that the amendments to
section 2590h of the education law made by sections three and four of
this act shall not affect the expiration of such section and shall be
deemed repealed therewith. Effective immediately, the addition, amend-
ment and/or repeal of any rule of regulation necessary for the implemen-
tation of this act on its effective date are authorized to be made and
completed on or before such date.

 
JUSTIFICATION:

The purpose of this bill is to implement Caribbean steel band/Steel
Orchestra, music classes in NYC schools K-12th Grade to develop curric-
ulums in order to instill pride in self-representation by incorporating
it into standard coursework.

Providing a safe space for steel bands to rehearse has been a problem
for decades and this bill will provide these bands the needed space to
store their instruments and offer them a place that is safe for their
players to rehearse.

EFFECTIVE DATE:
This act shall take effect on the ninetieth day after it shall have
become a law; provided, however, that the amendments to section 2590-h

therewith. Effective immediately, the addition, amendment and/or repeal
of any rule of regulation necessary for the implementation of this act

 AN ACT to amend the education law, in relation to enacting the "New York

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Short  title. This act shall be known and may be cited as
 the "New York city Caribbean steel pan educational music program act".
   § 2. Paragraph (c) of subdivision 1 of section 414  of  the  education
 law,  as  amended by chapter 345 of the laws of 2009, is amended to read
 as follows:
   (c) For holding social, civic and  recreational  meetings  and  enter-
 tainments,  and  other  uses pertaining to the welfare of the community;
 but such meetings, entertainment and uses  shall  be  non-exclusive  and
 shall be open to the general public; PROVIDED, HOWEVER, COMMUNITY SCHOOL
 BOARDS IN THE CITY OF NEW YORK SHALL AUTHORIZE THE USE OF SCHOOL GROUNDS
 DURING  THE SUMMER MONTHS FOR USE BY ANY STEEL PAN MUSIC ORGANIZATION TO
 PRACTICE FOR THE LABOR DAY PARADE (WEST INDIAN CARNIVAL). Civic meetings
 shall include, but not be limited to, meetings  of  parent  associations
 and parent-teacher associations.
   § 3. Subdivision 27 of section 2590-h of the education law, as amended
 by chapter 345 of the laws of 2009, is amended to read as follows:
   27.  Promulgate regulations, in conjunction with each community super-
 intendent, establishing a plan for providing access to school facilities
 in each community school district, when not in use for school  purposes,
 in  accordance  with  the provisions of section four hundred fourteen of
 this chapter.  SUCH PLAN SHALL INCLUDE ACCESS TO SCHOOL  GROUNDS  DURING
 THE  SUMMER MONTHS FOR STEEL PAN MUSIC ORGANIZATIONS TO PRACTICE FOR THE
 LABOR DAY PARADE (WEST INDIAN CARNIVAL). Such plan  shall  set  forth  a
 reasonable  system  of  fees  not to exceed the actual costs and specify
 that no part of any fee shall  directly  or  indirectly  benefit  or  be

   §  4.  Section  2590-h of the education law is amended by adding a new
 subdivision 57 to read as follows:
   57. ESTABLISH STEEL PAN MUSIC CURRICULUM OR INSTRUCTION FOR  COMMUNITY
 SCHOOL  DISTRICTS.  THE  CONTENTS  MAY  BE  VARIED  TO MEET THE NEEDS OF
 PARTICULAR COMMUNITY SCHOOL DISTRICTS, OR PORTIONS THEREOF, AND NEED NOT
 BE UNIFORM THROUGHOUT THE CITY. THE CONTENT SHALL BE AGE APPROPRIATE AND
 SHALL BE DEVELOPED ACCORDING TO THE NEEDS AND  ABILITIES  OF  PUPILS  AT
 SUCCESSIVE  GRADE  LEVELS  IN ORDER TO PROVIDE SKILLS AND INFORMATION ON
 STEEL PAN MUSIC.
   § 5. This act shall take effect on the ninetieth day  after  it  shall
 have  become  a  law;  provided, however, that the amendments to section
 2590-h of the education law made by sections three and four of this  act
 shall  not  affect  the  expiration  of such section and shall be deemed
