TITLE OF BILL:

An act to amend the general business law, in relation to requiring
retailers of bicycles with electric assist and electric batteries to
provide customers with an operating manual; and to amend the real prop-
erty law, in relation to requiring residential leases to contain a lease
rider indicating that the tenant agrees to not use electrical outlets
for charging of electric batteries in such leased residence

 
SUMMARY OF PROVISIONS:

Section 1. The general business law is amended by adding a new section
391.

§ 2. The real property law is amended by adding a new section 235-j.

§ 3. Effective date

 
JUSTIFICATION:

To assist in the prevention of overcharging and explosion of batteries
for electric assist bicycles. This legislation requires that retailers
supply the customer with the operating manual and that all tenants agree
not to use the electric outlets within their resident to charge electric
assist batteries. Here are just a few of the fires in New York City
caused by e-bike and e-scooter batteries last year, which reached a
record of 104 fires, resulting in 79 injuries and four deaths. These
numbers more than doubled from the previous year, when 44 fires led to
23 injuries, up from 28 fires in 2019.

An e-bike's battery burst into flames while charging in a Bronx restau-
rant, starting a four-alarm fire that drew more than 150 first respon-
ders and left one firefighter seriously injured.

A man was killed and multiple families displaced when the nine e-bike
batteries he was charging erupted inside his apartment. The force of the
blast blew out the windows and collapsed an internal wall, according to
the FDNY.

An E-scooter battery fire tore through a house end killed a 9-year-old
boy.

This act shall take effect on the sixtieth day after it shall have

 AN ACT to amend the general  business  law,  in  relation  to  requiring

   property law, in relation to requiring residential leases to contain a

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The general business law is amended by adding a new section
 391-cc to read as follows:
   § 391-CC. SALE  OF  BICYCLES  WITH  ELECTRIC  ASSIST; SALE OF ELECTRIC
 BATTERIES. NO PERSON REGULARLY ENGAGED IN THE BUSINESS OF SELLING  BICY-
 CLES  WITH  ELECTRIC  ASSIST OR LITHIUM ION ELECTRIC BATTERIES AT RETAIL
 SHALL SELL ANY SUCH BICYCLES OR BATTERIES WITHOUT PROVIDING THE PURCHAS-
 ER AN OPERATING MANUAL FOR SUCH BICYCLE WITH ELECTRIC ASSIST OR FOR SUCH
 LITHIUM ION  ELECTRIC  BATTERY.  SUCH  OPERATING  MANUAL  SHALL  INCLUDE
 INSTRUCTIONS  ON  HOW TO STORE AND CHARGE THE BATTERY, WHEN AND WHERE TO
 CHARGE THE BATTERY, AND WHAT TO DO IF THE BATTERY  OVERHEATS  OR  LEAKS,
 THERE IS A STRANGE ODOR OR NOISE ASSOCIATED WITH THE BATTERY OR THERE IS
 A CHANGE IN THE SHAPE OR COLOR OF THE BATTERY.
   § 2. The real property law is amended by adding a new section 235-j to
 read as follows:
   § 235-J. LEASE  RIDER  FOR  CHARGING ELECTRIC BATTERIES. EACH OWNER OF
 RESIDENTIAL REAL PROPERTY SHALL FURNISH TO EACH TENANT SIGNING A NEW  OR
 RENEWAL  LEASE, A RIDER INDICATING THAT SUCH TENANT AGREES TO NOT USE AN
 ELECTRICAL OUTLET FOR THE  PURPOSE  OF  CHARGING  AN  ELECTRIC  BATTERY,
 INCLUDING  BUT NOT LIMITED TO, LITHIUM ION BATTERIES AND A BATTERY MEANT
 FOR USE IN A BICYCLE WITH ELECTRIC ASSIST. SUCH RIDER SHALL BE  ATTACHED
 AS AN ADDENDUM TO THE LEASE.

                       [ ] is old law to be omitted.

DIFFERENCE BETWEEN PREVIOUS AND AMENDED VERSION

This bill has been amended by removing the original bill's addition of a
section to the real property law that would have required residential
leases to contain a rider indicating that the tenant agrees to not use
electrical outlets in the leased premises. for charging of electric
batteries

 AND  CHARGE  THE BATTERY, WHEN AND WHERE TO CHARGE THE BATTERY, AND WHAT
 TO DO IF THE BATTERY OVERHEATS OR LEAKS, THERE  IS  A  STRANGE  ODOR  OR
