BILL NUMBER: S7703 SPONSOR: HOYLMAN-SIGAL TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to requiring limited use motorcycles to be registered at point of sale PURPOSE OF BILL: To ensure that all limited use motorcycles are registered at the point of sale. SUMMARY OF SPECIFIC PROVISIONS: Section one amends section 2261 of the vehicle and traffic law by adding a new subdivision six. This new subdivision requires that all limited use motorcycles must be registered at the point of sale. Those vehicles bought to be used exclusively outside of New York shall be exempt as long as the purchaser signs a declaration, provided by the dealer, that they understand the registration requirements. Such a declaration shall be sent to the DMV commissioner.

HOYLMAN-SIGAL -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the vehicle and traffic law, in relation to requiring limited use motorcycles to be registered at point of sale THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2261 of the vehicle and traffic law is amended by adding a new subdivision 6 to read as follows: 6. REGISTRATION AT TIME OF SALE. EVERY LIMITED USE MOTORCYCLE, AS DEFINED BY SECTION ONE HUNDRED TWENTY-ONE-B OF THIS CHAPTER, SOLD BY A DEALER SHALL BE REGISTERED AT THE TIME OF SALE OF SUCH VEHICLE. SUCH REGISTRATION SHALL BE VALID UNTIL THE THIRTY-FIRST DAY OF AUGUST FOLLOW- ING THE DATE OF SUCH SALE; PROVIDED, HOWEVER, THAT ANY LIMITED USE MOTORCYCLE SOLD AFTER APRIL FIRST OF EACH YEAR SHALL BE ISSUED A REGIS- TRATION VALID UNTIL THE THIRTY-FIRST DAY OF AUGUST IN THE YEAR FOLLOWING THAT IN WHICH THE LIMITED USE MOTORCYCLE IS SOLD. ANY LIMITED USE MOTOR- CYCLE PURCHASED FOR USE EXCLUSIVELY OUTSIDE OF THE STATE OF NEW YORK SHALL NOT REQUIRE REGISTRATION AT THE TIME OF PURCHASE, AND THE PURCHAS- ER OF SUCH LIMITED USE MOTORCYCLES SHALL SIGN A DECLARATION, PROVIDED BY THE DEALER, WHICH SHALL STATE THAT SUCH PURCHASER UNDERSTANDS THE CONDI- TIONS UNDER WHICH A LIMITED USE MOTORCYCLE MUST BE REGISTERED AND THE PENALTY FOR VIOLATION OF SUCH REGISTRATION PROVISIONS. EACH SIGNED DECLARATION SHALL BE FORWARDED BY THE DEALER TO THE COMMISSIONER. THE FORM OF SUCH DECLARATION SHALL BE PROVIDED BY THE COMMISSIONER TO EACH DEALER. § 2. SUMMARY OF SPECIFIC PROVISIONS: Section one amends section 2267-a of the vehicle and traffic law by adding new subdivisions one through 11, which require that dealers of limited use motorcycles issue temporary registration tags to those purchasing such vehicles, only after obtaining from the customer and submitting to the Department of Motor Vehicles all necessary documenta- tion and completed forms, in a manner prescribed by the commissioner.

The vehicle and traffic law is amended by adding a new section 2267-a to read as follows: § 2267-A. DEALERS AND MANUFACTURERS OF LIMITED USE MOTORCYCLES. 1. WHERE A DEALER HAVING A REGISTRATION UNDER THE PROVISIONS OF SECTION FOUR HUNDRED FIFTEEN OF THIS CHAPTER SELLS OR TRANSFERS A LIMITED USE MOTORCYCLE, THEY SHALL ISSUE A TEMPORARY REGISTRATION FOR SUCH LIMITED USE MOTORCYCLE, WHICH REGISTRATION SHALL PERMIT SUCH LIMITED USE MOTOR- CYCLE TO BE OPERATED AS A DULY REGISTERED VEHICLE FOR A PERIOD OF THIRTY DAYS FROM THE DATE OF ISSUANCE, OTHER PROVISIONS OF THIS CHAPTER NOTWITHSTANDING. SUCH TEMPORARY REGISTRATION MAY BE EXTENDED BY THE COMMISSIONER FOR AN ADDITIONAL THIRTY DAYS AND SHALL CONSIST OF A FORM OR FORMS WHICH SHALL BE OBTAINED FROM THE COMMISSIONER BY THE DEALER, AND EXECUTED, ISSUED AND DISPLAYED IN ACCORDANCE WITH THE PROVISIONS OF THIS SECTION AND IN SUCH MANNER AS THE COMMISSIONER SHALL PRESCRIBE. 2. A QUALIFIED DEALER MAY OBTAIN TEMPORARY REGISTRATIONS TO BE ISSUED IN ACCORDANCE WITH THE PROVISIONS OF THIS SECTION BY APPLYING TO THE COMMISSIONER AND PAYING A FEE OF THREE DOLLARS FOR EACH SUCH TEMPORARY REGISTRATION. THE COMMISSIONER MAY LIMIT THE NUMBER OF TEMPORARY REGIS- TRATIONS GIVEN TO A DEALER AT ANY ONE TIME OR THE NUMBER OF UNISSUED TEMPORARY REGISTRATIONS IN THE POSSESSION OF A DEALER AT ONE TIME. 3.
