BILL NUMBER: S7760 SPONSOR: CHU TITLE OF BILL: An act to amend the general business law, in relation to requiring charging cords for bicycles with electric assist and elec- tric scooters to have a red tag attached PURPOSE: Requires bicycles with electric assist and electric scooters to have a red tag attached to the charging cord which states to unplug in emergen- cy. SUMMARY OF PROVISIONS: Section 1 requires that any e-bike or e-scooter sold by an individual or a company must have a red tag affixed to the charging cord near the end which is plugged into the electricity source which states "Unplug in Emergency" in a clear and conspicuous manner. Section 2 provides the effective date.

CHU -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the general business law, in relation to requiring charging cords for bicycles with electric assist and electric scooters to have a red tag attached THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 399-nnn to read as follows: § 399-NNN. TAGS ON CHARGING CORDS OF BICYCLES WITH ELECTRIC ASSIST AND ELECTRIC SCOOTERS. NO PERSON, FIRM, OR CORPORATION SHALL SELL OR OFFER FOR SALE AT RETAIL ANY BICYCLE WITH ELECTRIC ASSIST OR ELECTRIC SCOOTER UNLESS THERE IS A RED TAG AFFIXED TO THE CHARGING CORD OF SUCH BICYCLE OR SCOOTER WHICH CLEARLY AND CONSPICUOUSLY STATES "UNPLUG IN EMERGENCY". SUCH TAG SHALL BE AFFIXED TO THE CORD NEAR THE END WHICH IS PLUGGED INTO THE ELECTRICITY SOURCE. § 2. This act shall take effect immediately. NO PERSON, FIRM, PARTNERSHIP, ASSOCIATION, OR CORPORATION SHALL MANUFACTURE, DISTRIBUTE, ASSEMBLE, RECONDITION, SELL OR OFFER FOR SALE AT RETAIL ANY MICROMOBILITY DEVICE, MOPED, OR BICYCLE WITH ELECTRIC ASSIST AS DEFINED IN SECTION ONE HUNDRED TWO-C OF THE VEHICLE AND TRAFFIC LAW UNLESS THERE IS A RED TAG AFFIXED TO THE CHARGING CORD OF SUCH MICROMOBILITY DEVICE, MOPED, OR BICYCLE WITH ELECTRIC ASSIST WHICH CLEARLY AND CONSPICUOUSLY STATES "UNPLUG WHEN NOT IN USE". SUCH TAG SHALL INCLUDE ADDITIONAL CONSUMER SAFETY INFORMA- TION REGARDING SAFE USAGE OF THE PRODUCT AND ITS CHARGING EQUIPMENT AND SHALL BE AFFIXED TO THE CORD NEAR THE END WHICH IS PLUGGED INTO THE ELECTRICITY SOURCE. 2. THE DEPARTMENT OF STATE SHALL PROMULGATE RULES AND REGULATIONS PROVIDING GUIDANCE ON THE CONSUMER SAFETY INFORMATION REQUIRED TO BE ON THE TAG PURSUANT TO SUBDIVISION ONE OF THIS SECTION. 3.
