BILL NUMBER: S7846 SPONSOR: WEBB TITLE OF BILL: An act to amend the public health law, in relation to access to physical copies of patient information by qualified persons PURPOSE: This bill establishes a patients right to receive a paper copy of their medical records SUMMARY OF PROVISIONS: Section 1 amends the paragraph (d) of subdivision 2 of section 18 of the public health law, which applies to records maintained by health care facilities and practitioners licensed by the Department of Health, by specifying that a qualified person may request a physical copy of any patient information. Section 2 provides for an immediate effective date.

WEBB -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to access to physical copies of patient information by qualified persons THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (d) of subdivision 2 of section 18 of the public health law, as amended by chapter 576 of the laws of 1998, is amended to read as follows: (d) Subject to the provisions of subdivision three of this section, upon the written request of any qualified person, a health care provider shall furnish to such person, within a reasonable time, a copy of any patient information requested, and original mammograms requested, which the person is authorized to inspect pursuant to this subdivision. A QUALIFIED PERSON MAY REQUEST A PHYSICAL COPY OF ANY PATIENT INFORMATION REQUESTED PURSUANT TO THIS SECTION. § 2. This act shall take effect immediately.
