 Introduced  by Sen. HARCKHAM -- read twice and ordered printed, and when
   printed to be committed to the Committee on Environmental Conservation
 
 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   requiring  for  construction activities that require a state pollutant
   discharge elimination system permit owners and operators to  submit  a
   copy of the required public notice

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 1  of  section  17-0805  of  the  environmental
 conservation  law  is  amended  by adding a new paragraph a-1 to read as
 follows:
   A-1. (I) FOR STORM WATER FROM CONSTRUCTION ACTIVITIES THAT REQUIRES  A
 SPDES  PERMIT,  THE OWNER OR OPERATOR SHALL PROVIDE A COPY OF THE PUBLIC
 NOTICE REQUIRED BY PARAGRAPH A OF THIS  SUBDIVISION  TO  THE  COUNTY  OR
 COUNTIES IN WHICH SUCH CONSTRUCTION ACTIVITIES TAKE PLACE, AND ALL OTHER
 COUNTIES, THE WATERS OF WHICH MAY BE AFFECTED.
   (II) EACH COUNTY RECEIVING SUCH NOTICE SHALL MAKE SUCH NOTICE PUBLICLY
 AVAILABLE ON ITS WEBSITE IN A MANNER PRESCRIBED BY THE DEPARTMENT.
   § 2. This act shall take effect on the one hundred eightieth day after
 it  shall have become a law. Effective immediately, the addition, amend-
 ment and/or repeal of  any rule or regulation necessary for  the  imple-
 mentation  of  this  act on its effective date are authorized to be made
 and completed on or before such effective date.
