BILL NUMBER: S8443 SPONSOR: PALUMBO TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to exempting certain parcels of land from licensing restrictions for manufacturers and wholesalers of alcoholic beverages who sell at retail for on-premises consumption PURPOSE: To amend Chapter 328 of the Laws of 2022 by providing the metes and bounds of the new location of Talkhouse Encore, in the town of East Hampton. SUMMARY OF PROVISIONS: Section 1. Amends subparagraph (xiv) of paragraph (a) of section 101(1) of the alcoholic beverage control law by replacing the metes and bounds of Talkhouse Encore in the town of East Hampton that is on the list of parcels which are exempt from the tied-house laws.

PALUMBO -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the alcoholic beverage control law, in relation to exempting certain parcels of land from licensing restrictions for manufacturers and wholesalers of alcoholic beverages who sell at retail for on-premises consumption THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (xiv) of paragraph (a) of subdivision 1 of section 101 of the alcoholic beverage control law, as added by chapter 328 of the laws of 2022, is renumbered (xviii) and amended to read as follows: (xviii) [ALL that certain plot, piece or parcel of land, situate, lying and being a part of a condominium in the Town of East Hampton, County of Suffolk and State of New York, known and designated as Unit No. 109, together with a 6.167% undivided interest in the common elements of the condominium hereinafter described as the same is defined in the Declaration of Condominium herein after referred to. THE Condominium Unit (hereinafter referred to as the Unit) known as a Unit, said unit being designated in the Town of East Hampton, on "Map of East Hampton Office Park Condominium" filed 2/6/91 as map No. 237, and described as Unit No 109 in a certain Declaration dated 1/22/91, made by Pantigo Office Associates, Inc. Pursuant to Article 9-B of the Real Property Law of the State of New York, establishing a plan for Condomin- ium ownership of the Building and Land upon which the building is situ- ate, described below, which Declaration was recorded in the Suffolk County Clerk's Office on 2/6/91 in Liber 11215 cp 01, as may be amended] ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND, WITH THE BUILDINGS AND IMPROVEMENTS THEREON ERECTED, SITUATE, LYING AND BEING IN THE TOWN OF EAST HAMPTON, COUNTY OF SUFFOLK AND STATE OF NEW YORK, KNOWN AND DESIG- NATED AS LOTS 81 THROUGH 86, INCLUSIVE IN BLOCK 2, AS SHOWN ON THAT CERTAIN MAP ENTITLED, "MAP OF MONTAUK MANOR, SECTION 1", WHICH MAP WAS FILED IN THE OFFICE OF THE CLERK OF THE COUNTY OF SUFFOLK ON SEPTEMBER EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
