BILL NUMBER: S8508 SPONSOR: TEDISCO TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to an exemption for certain property from the prohibition of alcohol sales within a certain distance from a church PURPOSE OR GENERAL IDEA OF BILL: This bill will authorize the issuing of a retail liquor license to a business in the City of Saratoga Springs, in Saratoga County. SUMMARY OF PROVISIONS: Section 1: Subdivision 7 of section 64 of the alcoholic beverage control law is amended by adding a new paragraph (e-16) to authorize the issuing of a retail license for on-premises consumption for a premises which shall be located within two hundred feet of a building occupied as a church, synagogue or other place of worship, provided such premises constitute a premises for the sale of food or beverages at retail for

TEDISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Commerce, Economic Devel- opment and Small Business AN ACT to amend the alcoholic beverage control law, in relation to an exemption for certain property from the prohibition of alcohol sales within a certain distance from a church THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 64 of the alcoholic beverage control law is amended by adding a new paragraph (e-16) to read as follows: (E-16) NOTWITHSTANDING THE PROVISIONS OF PARAGRAPH (A) OF THIS SUBDI- VISION, THE AUTHORITY MAY ISSUE A RETAIL LICENSE FOR ON-PREMISES CONSUMPTION FOR A PREMISES WHICH SHALL BE LOCATED WITHIN TWO HUNDRED FEET OF A BUILDING OCCUPIED AS A CHURCH, SYNAGOGUE OR OTHER PLACE OF WORSHIP, PROVIDED SUCH PREMISES CONSTITUTE A PREMISES FOR THE SALE OF FOOD OR BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREMISES LOCATED WHOLLY WITHIN THE BOUNDARIES OF THE COUNTY OF SARATOGA, BOUNDED AND DESCRIBED AS FOLLOWS: ALL THAT CERTAIN TRACT, PIECE OR PARCEL OF LAND, SITUATE, LYING AND BEING IN THE CITY OF SARATOGA SPRINGS, COUNTY OF SARATOGA AND STATE OF NEW YORK, BOUNDED AND DESCRIBED AS FOLLOWS: COMMENCING AT A POINT IN THE NORTHERLY LINE OF WASHINGTON STREET WHERE THE DIVISION LINE BETWEEN THE LAND HEREBY DESCRIBED AND THE LAND NOW OR LATE OF PETER V. WIGGINS MEETS THE SAID NORTHERLY LINE OF WASHINGTON STREET AND RUNNING THENCE WESTERLY ALONG THE SAID NORTHERLY LINE OF WASHINGTON STREET ONE HUNDRED TEN (110') FEET MORE OR LESS TO THE DIVI- SION LINE BETWEEN THE LAND HEREBY DESCRIBED AND THE LAND NOW OR LATE OF EDWARD R.
