TITLE OF BILL:

An act to amend the agriculture and markets law, in relation to the
definitions of surplus agricultural products and processed products for
the purposes of the Nourish New York program

 
PURPOSE OR GENERAL IDEA OF BILL:

The purpose of this bill is to amend the Nourish New York program to
include whole or 2% fat milk, in order to give consumers, the option to
purchase healthier, fresher and more nutritious locally grown products.

 
SUMMARY OF PROVISIONS:

Section 1. Subdivisions 2 and 3 of section 451 of the agriculture and
markets law is amended.

Section 2. Establishes the effective date.

 
JUSTIFICATION:

The Nourish NY anti-hunger program has been successful in providing New
Yorkers in need with greater access to fresh fruits, vegetables, and
dairy products.

A recent NYS Comptroller audit found that, the Department of Health's
use of Hunger Prevention and Nutrition Assistance Program (HPNAP) stand-
ards have excluded nutritious and healthy locally grown agricultural
products such as whole or 2% fat milk. The department of Health's stand-
ards are inconsistent with other anti-hunger or nutrition program stand-
ards. The Federal Women Infant and Children (WIC) supplemental nutrition
program includes the purchasing of whole or 2% fat milk.

Amending the program to include whole or 2% fat milk will provide addi-
tional access to this nutritious form of milk and provide additional
markets to our state's farmers.

 
PRIOR LEGISLATIVE HISTORY:

This is new legislation.

 
FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS:

This legislation will have no fiscal implications. The FY 24125 Execu-
tive budget contains $50 million for this program.

 
EFFECTIVE DATE:
This act shall take effect immediately

 AN ACT to amend the agriculture and markets  law,  in  relation  to  the
   definitions  of  surplus  agricultural products and processed products
   for the purposes of the Nourish New York program
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1.  Subdivisions 2 and 3 of section 451 of the agriculture and
 markets  law,  subdivision  2  as  amended and subdivision 3 as added by
 chapter 101 of the laws of 2022, are amended to read as follows:
   2. "Surplus agricultural products" means consumable or edible agricul-
 tural products grown, produced or harvested in New York, including proc-
 essed products as defined pursuant to subdivision three of this section,
 but shall not include beverages containing  alcohol.  "SURPLUS  AGRICUL-
 TURAL PRODUCTS" SHALL ALSO INCLUDE NEW YORK GROWN, PRODUCED OR HARVESTED
 WHOLE  MILK,  TWO  PERCENT  FAT MILK, AND OTHER FARM PRODUCED BEVERAGES,
 WITH THE EXCEPTION OF BEVERAGES CONTAINING ALCOHOL.
   3. "Processed products"  means  any  agricultural  commodity  that  is
 grown,  produced or harvested in New York state and further processed by
 butchering, freezing, canning, PASTEURIZING, BOILING, altering its state
 and/or blending with other ingredients, so long  as  the  final  product
 contains  at  least  fifty-one  percent by weight or volume agricultural
 products that are grown,  produced  or  harvested  in  New  York  state,
 regardless of where processed.
   § 2.  This act shall take effect immediately.
